Abstract

V diplomski nalogi so strnjeni vsi pomembnejši podatki v zvezi s policijskim prijetjem. Uvodnemu delu sledi predstavitev zakonske podlage policijskih pooblastil ter policijske etike in pregled policijskih pooblastil s temeljnimi načeli, ki jih je potrebno upoštevati pri odvzemu prostosti, nadzora nad izvajanjem policijskih pooblastil in zakonsko dovoljenega omejevanja osebne svobode. Tretje poglavje podrobneje opisuje postopek prijetja ter pravice prijete osebe. V četrtem poglavju so opredeljene razlike med primarnim in sekundarnim policijskim prijetjem. Šesto poglavje je namenjeno analizi slovenske zakonodaje, povezane s policijskim prijetjem, in primerjavo z evropsko in mednarodno zakonodajo. Poglavju statistična analiza pridržanih oseb sledi splošna ocena empiričnega dela in primerjave v sedmem poglavju. Na podlagi preverjanja hipotez privedejo do ugotovitev, na katerih temelji zaključek. Analizirali smo veljavno slovensko zakonodajo s pravno osnovo za policijsko prijetje z upoštevano diskrecijo ter jo primerjali z ameriško zakonodajo. V proučevanju slovenske zakonodaje, smo uporabili tudi najnovejši sprejet Zakon o nalogah in pooblastilih policije, v katerem je policijsko prijetje opredeljeno kot začasna omejitev svobode. S primerjavo slovenske ureditve z evropsko in ameriško zakonodajo, so predstavljeni različni instituti omejitve osebne svobode.

Secondary abstract: In the thesis are summarized all important data relating to police arrest. The introductory part is followed by the presentation of the legal basis of police powers and police ethics and a review of police powers to the fundamental principles that need to be considered in custody, supervision of the implementation of police powers and legally permissible restriction of person freedom. The third chapter describes in detail the process of arrest and the rights of the arrested person. In the fourth chapter defined the differences between primary and secondary police arrest. The sixth chapter is devoted to analyzing the Slovenian legislation relating to police arrest and comparison with international laws. Chapter statistical analysis of detainees following the overall assessment and empirical comparisons in the seventh chapter. Based on the review findings lead to the hypothesis on which the conclusion. We analyzed Slovenian legislation with the legal basis for the police to arrest observed discretion, and compared it with the American law. In the study of Slovenian legislation, we also used the recent adoption of the Law on the task and powers of the police, which the police arrest defined as a temporary restriction of freedom. By comparing the Slovenian legislation with European and American presented various institutes restrictions of personal freedom.
