Abstract

V diplomski nalogi je analizirana problematika razlaščanja zemljišč (odvzem lastninske pravice) na podlagi judikatov in odločb Vrhovnega sodišča in Upravnih sodišč v obdobju od 2006 do 2010. Analizirana so tudi cenitvena poročila, pridobljena na Upravni enoti Celje, ki se nanašajo na konkretne razlastitvene postopke. Diplomska naloga se osredotoča na veljavno zakonodajo na področju razlastitve, to je Zakon o urejanju prostora (ZUreP-1). Analiza judikatov in cenitvenih poročil je pokazala določene probleme v postopku razlastitve, še posebej dolgotrajnost postopkov razlastitve zaradi usklajevanja odškodnine za razlastitev nepremičnin in stranskih stroškov, ter problem kategorizacije zemljišč, ki se razlaščajo. V zaključnem delu je podanih tudi nekaj možnih predlogov za izboljšanje stanja.

Secondary title: Real estate valuation in the expropriation procedure
Secondary abstract: This thesis analyses the problematic of expropriating property (deprivation of property rights) on the basis of judgements and orders of the Supreme Court and Administrative Courts in the era between 2006 and 2010. We have also analysed valuation reports acquired at the Celje Administrative Unit that apply to actual expropriation procedures. The thesis focuses on applicable law in the field of expropriation, which is the Spatial Management Act (ZUreP-1). The analysis of judgements and valuation reports has shown certain problems in expropriation procedures, especially their longevity due to compensation coordination for expropriating real estate and side costs, as well as the problem of categorising property which is being expropriated. The final part of the thesis also offers some possible suggestions for improvement.
