Abstract

Zapori so državne institucije, v katere se zapirajo storilci kaznivih dejanj. Ljudi se za neupoštevanje družbenih pravil kaznuje odkar družba obstaja. Skozi leta se je način kaznovanja storilcev kaznivih dejanj spreminjal. Od telesnih kazni in mučenja storilcev je prišlo do kaznovanja, ki vpliva na duševnost posameznikov. Tako, kot se je spreminjal način kaznovanja, se je spreminjal tudi namen zaporne kazni. Če je šlo nekoč samo za maščevanje za storjeno kaznivo dejanje, se danes poskuša doseči prevzgoja zapornikov. Poleg kazni pozna slovensko kazensko pravo še druge vrste kazenskih sankcij, katerih namen je preprečevanje nadaljnjega izvrševanja kaznivih dejanj. V diplomski nalogi so raziskovani odnosi med samimi zaporniki in zaporniki ter pazniki v zavodu za prestajanje kazni zapora Dob. Dobri odnosi med osebjem in zaporniki so ključni za dobro družbeno vzdušje v zavodih. Korektnost osebja do zapornikov pripomore k spoštovanju zaporskih pravil. Spoštljiv odnos do zaprtih pa pomaga pri njihovi resocializaciji. Za resocializacijo so pomembne tudi različne oblike tretmanov, ki so jih zaporniki deležni v obdobju prestajanja kazni. Kljub temu, da naj bi bili po odpustu iz zavoda resocializirani, se na prostosti soočajo s številnimi težavami. Zelo težko se vključujejo v družbo, saj jih ta zavrača. Kot bivši kaznjenci težko dobijo zaposlitev, saj jim družba ne zaupa. Pri spopadanju s težavami jim pomagajo Centri za socialno delo. Ker se velik del zapornikov po prestani kazni ponovno vrača k izvrševanju kaznivih dejanj, je bil predstavljen še problem povratništva. Ugotovljeno je bilo, da se tveganje za povratništvo poveča po vsaki naslednji prestani kazni. Na podlagi postavljene prognoze zapornika pa lahko povratništvo z veliko verjetnostjo napovemo.

Secondary abstract: Prisons are national institutions where the law offenders are imprisoned. People who failed to follow the rules of society have been punished ever since the existence of society. Throughout the years the way to punish these offenders has changed. From physical punishment and torture they came up with a way of punishment that affected their souls. As the methods of punishment changed, so did the purpose of imprisonment. If the punishment was once just a vengeance for the criminal act, today they try to achieve reeducation of prisoners. In addition to penalty, the slovenian criminal law also knows other types of penal sanctions aiming to prevent further execution of criminal act. In my diploma I have researched the relationship between prisoners themselves and relationship between them and the guards in prison Dob. Good relationships between employees and prisoners are key for better social atmosphere in institutions. The appropriate relationship towards the prisoners helps with respecting the prison rules and their resocialization. Important for achieving a successful resocialization are also different types of treatments, received during the time of imprisonment. Despite the resocialization process, the prisoners face a lot of problems when they are released. They find it hard to integrate back in society because they are more than often rejected by it. As former convicts they struggle to get a job, because no one trusts them. The social work centers are there to help them with various problems. Because the majority of prisoners, after serving their sentence, still return to committing offenses, I did a little research on the problem of recidivism. I found out that the risk for recidivism enlarges after every served sentence. Based on prisoner prognosis the recidivism can be highly predicted.
