Abstract
Energetska politika je ena izmed bistvenih politik EU. Notranji trg EU se je razvijal postopoma. Predmet raziskave diplomskega dela je notranji trg z električno energijo in plinom v EU. Vzpostavitev integracije na omenjenem področju je proces, ki poteka postopoma in še ni dokončan. Dejavnost oskrbe z električno energijo in zemeljskim plinom je služba v javnem interesu. To je pomemben vidik, ki ga ne smemo zaobiti. Za uspešno graditev elektroenergetskega in trga z zemeljskim plinom je potrebna zakonodajna aktivnost na ravni EU. Države članice pa morajo zakonodajo prenesti v nacionalne pravne rede. V omenjenih sektorjih je prevladovala zaprtost in nedovzetnost držav po integraciji. Težave pri prenosu pravnih aktov so aktualne še danes.
V diplomski nalogi na podlagi analize zakonodaje predstavljam, kako naj bi se vzpostavil notranji energetski trg z električno energijo ter plinom na ravni EU. Predstavljam, kako poteka razvoj in kakšni so končni cilji na tem področju, kakšne koristi odprt in liberaliziran evropski energetski trg prinaša končnim uporabnikom. Upoštevati je potrebno tudi določbe konkurenčnega prava, v vedenju je potrebno imeti, da gre za izvajanje javnih služb oskrbe z električno energijo ter zemeljskim plinom. V drugem delu pa sledi dejanska in pravna analiza stanja na energetskem področju v Sloveniji. Predstavljam organizacijo in razvoj trga z električno energijo in plinom v zadnjih letih. Na podlagi analize sledi pregled trenutnega stanja in primerjava s smernicami, ki jih določa pravo EU. V zaključku ob povzetku zakonodajnega predloga novega Energetskega zakona EZ-1 predstavljam predvideno bodočo ureditev problematike v Sloveniji.

Energy policy is one of the main EU policies. EU internal market has evolved step by step. The subject matter of the thesis is the internal market of electricity and gas in the EU.Establishing integration in this area is a process, which takes place gradually and it is not finished yet. The supply of electricity and gas is considered to be service in the public interest.This is an important aspect that can not be circumvented.To successfully build the internal electricity and gas market, legislative action at EU levelis required. Member States must transpose it into national law. These sectors are dominated by constipation and insensitivity of Member States for integration. Difficulties in transposing the legislation are still relevant today.
In thesis, based on the analysis of the laws, I present how to complete the internal market for electricity and gas on the EU level. I check how the development process goes on and what the final goals in this area are. Which are the benefits that open and liberalized European energy market brings to end users.The provisions of competition law must be respected, as it must be emphasised that electricity and gas supply is service in the public interest. The second part of the thesis consists of practical and legal analysis of the situation in the energy sector in Slovenia.The organization and development of the electricity and gas market in recent years are reflected. Based on the analysis, the thesis examination of the current status and comparisonwith the guidelines laid down by EU law. To conclude, by the summary of the legislative proposal for a new Energy act EZ-1, I present future legislation of this area in Slovenia. |
