Abstract

V diplomskem delu smo predstavili transplantacijsko dejavnost kot vejo medicine, njen razvoj pri nas ter različne zakonske in etične ovire, ki jih povezujemo s transplantacijami. Zdravljenje s presaditvijo organov je zelo uspešno, vendar je število presajenih organov še vedno nizko, saj je na voljo dosti manj organov, kot bi jih potrebovali. Izpostavili smo tudi problem zlorab pri darovanju organov, ki se pojavljajo in so najverjetneje tudi eden glavnih razlogov za skeptičen pogled družbe na transplantacijsko dejavnost. Ker pa je človek svobodno in avtonomno bitje, ki samo odloča o sebi, smo poudarili tudi pomen avtonomije in pogoje, ki avtonomnost dopuščajo. Eno poglavje je namenjeno tudi zakonski podlagi, ki ureja darovanje organov v Republiki Sloveniji in je ključno področje tega diplomskega dela. Zaradi vse večjih potreb po organih se tudi v zakonodaji vršijo določene spremembe. Ugotovili smo, da je transplantacijska dejavnost pri nas dobro urejena in nadzorovana, prav tako tudi v ostalih državah, ki so povezane v Eurotransplantu, vendar kljub temu najdemo posamezne primere zlorab.

Secondary abstract: In this thesis are presented transplantation activities as a branch of medicine, its development in our country and the various legal and ethical barriers that have been associated with transplantation. Treatment with organ transplantation is very successful, but the number of transplanted organs is still low, as there is much less organs available than needed. We have also raised the problem of organ donation abuse which is likely to be one of the main reasons for the skeptical view of the transplant activity in our society. However, since man is a free and autonomous being who is capable of his own decisions, we have emphasized the importance of autonomy and the conditions that allow autonomy. One chapter is devoted to the legal basis governing organ donation in the Republic of Slovenia and it is a key area of this thesis. Due to increasing demand for organs some changes were made in legislation. We found that the transplantation activity in our country is well regulated and supervised, as well as in other countries, which are connected to the Eurotransplant, but nevertheless individual cases of abuse are found.
