Abstract

Tako kot mnoge druge, tudi Republika Slovenija temelji na zakonih. Za uspešno delovanje je potrebno prilagajanje državljanov oblasti in državnim organom, kateri delujejo in odločajo v imenu celotnega ljudstva. Država stremi k temu, da bi bile njihove odločitve podprte v čim večji večini, kar bi imelo za posledico prostovoljno skladnost z zakoni in podrejanje oblasti, torej večjo stopnjo legitimnosti. Tako policija kot pravosodje sta tista državna organa, pri katerih legitimnost zaradi velike vloge povezanosti in sodelovanja z državljani igra še kako pomembno vlogo. Vendar pa so potrebni še drugi dejavniki, ki pripomorejo k večji učinkovitosti delovanja omenjenih institucij. Eden izmed njih je zaupanje, da policija deluje pošteno, učinkovito, da zagotavlja vrednote celotne populacije ter da deluje enakopravno do vseh državljanov. Če dojemamo policijo kot legitimno, zaupamo v njeno delo, verjamemo v njeno postopkovno in distributivno pravičnost in učinkovitost, ji bomo bolj naklonjeni, kar posledično vodi do večje možnosti sodelovanja s policijo. Sodelovanje javnosti s policijo, ki se kaže v prijavljanju kaznivih dejanj, opozarjanju na nered v skupnosti, sodelovanju kot priče v kazenskem postopku itd., pa vodi do večje učinkovitosti policije, ki bi bila brez pomoči javnosti manj uspešna pri odkrivanju in preiskovanju kaznivih dejanj. Vidimo, da so vsi elementi med seboj tesno povezani, kar smo želeli preveriti tudi v našem diplomskem delu. Izvedena je bila raziskava med študenti prava in varstvoslovja, ki so zaradi narave študija in dela v prihodnosti močno povezani s policijo in kazenskim pravosodjem, saj nas je zanimalo njihovo dojemanje policijskega dela ter odnos do policije. Ugotovili smo, da imajo predhodne izkušnje s kazenskopravnim sistemom vpliv na nadaljnji odnos in na sodelovanje s policijo. Tisti, ki so že bili v stiku s policijo, odnos do njih dojemajo kot profesionalen, zaradi česar je večje tudi zaupanje v njihovo delo. Zanimala nas je tudi razlika med študenti prav in varstvoslovja v dojemanju policije in odnosu do njih. Po predvidevanjih imajo študenti varstvoslovja več zaupanja v policijo ter bolj verjamejo v njihovo postopkovno in distributivno pravičnost, medtem, ko večjega sodelovanja študentov nismo uspeli potrditi. Študija je tudi pokazala, da študentje prava bolj verjamejo v enakovreden kaznovalni sistem za vse ljudi, kar je glede na naravo njihovega študija razumljivo.

Secondary abstract: Like many others, our country is based on laws. For successful functioning it is necessary that citizens adjust to government and state authority, which are working and making decisions in the name of the people. The country strives to be supported in their decisions by the majority, which would result in voluntary compliance with the law and the submission to the authorities, therefore a greater level of legitimacy. The police and the justice are the national authorities in which legitimacy plays an important role. However, other factors, which contribute to greater efficiency of these institutions, are needed. One of those factors is the belief that the police acts fairly, effectively and that it provides the values of the entire population and works equally for all citizens. If we comprehend the police as a legitimate, have confidence in its work, believe in its procedural and distributive justice and efficiency, we will be more inclined to it and that will result in greater possibility for cooperating with the police. Cooperation of the people with the police shows in reporting of the crimes, warning if there is a disorder in the community, participating as a witness in criminal proceedings etc. That leads to greater efficiency of the police, which would be, without the help of the public, less effective in detecting and investigating criminal offences. We can see that all the elements are closely linked and we wanted to show that in our thesis. A research study was conducted among the students of law and criminal justice and security. Because of the nature of their studies and their work in the future they are closely linked with the police and criminal justice and we were interested in their perception of the police work and their attitude towards the police. We came to the conclusion that previous experiences with the criminal justice system influence the future relationship and cooperation with the police. Those, who have already been in contact with the police, perceive the relationship towards it as a professional and that results in greater confidence in its work. We were also interested in the difference between Law students and students of the Criminal justice and security when it comes to comprehending the police and their attitude towards it. As predicted students of the Criminal justice and security have more confidence in the police and believe more in its procedural and distributive justice, while we could not prove greater cooperation of the students. The study also shows that more Law students believe in equal penal system, which is understandable due to the nature of their studies.
