Policijsko pridržanje pri preiskovanju gospodarske kriminalitete

Abstract

Po samosvojitvi Slovenije in po spremenbi družbeno-ekonomskega sistema so se pojavile poleg klasičnih tudi gospodarska kazniva dejanja, ki so bila sprva neobičajna in nerazumljiva. Tako je država bila primorana ustanoviti nove organe, ki so se lahko borili proti tej sofisticirani kriminaliteti. Nova oblika kriminalitete je bila vzrok, da so propadala in še propadajo različne gospodarske dejavnosti. V diplomski nalogi smo tako podrobneje predstavili pridržanje, ki je ena od hujši oblik odvzema svobode. Ta je pomembna, saj je s tem ukrepom organom pregona omogočeno bolj uspešno opravljanje svojega dela. Pri pridržanju je zelo pomemben čas pridržanja ter hitrost dela organov pregona, na podlagi katere lahko pride do kazenske ovadbe in na koncu posledično tudi do obtožbe. Tako smo v diplomski nalogi v prvem delu predstavili odreditev pridržanja, priporne razloge, pravila policistov med pridržanjem, potrebne dokomentacije, pravice pridržane osebe, opis prostorov za pridržanje, prenehanje razlogov za pridržanje ter nadzor nad pridržanjem. V drugem delu smo predstavili razlikovanje med klasično in gospodarsko kriminaliteto, dejanja, ki jih uvrščamo med gospodarsko kriminaliteto ter začetki borbe proti njej. Pregledali smo tudi povezanost in sodelovanje organov pregona ter njihove izbojšave. V zadnjem delu si bomo ogledali še statistične podatke po katerih bomo razbrali trend pojemanja ali naraščanja, tako policijskega pridržanja, kot gospodarske kriminalitete ter škodo, ki jo država pri tem utrpi.

Secondary abstract:	After Slovenia had become independent and after the changes in the social-economical system, there emerged not only classical but also economical crime activities which at first hadbeen unusual and incomprehensible. So, the state was forced to establish new authorities who could fight against that sophisticated crime. The new form of crime was the reason that different economical activities started to bankrupt and are still going bankrupt. In this final thesis there is in detail presented custody which is one of the worse forms of taking one's freedom. It is important because this consequence enables the authorities to carry out their work more successfully. When carrying out custody the time of it is very important, also the quickness of the authorities' work which leads to a criminal complaint and consequently to charge. In the first part of this final thesis there is presented the order of custody, reasons for custody, the rules of the police while commitment, the rights of the person in custody, the description of the space for custody, reasons for cancelling custody and the control of custody. In the second part there is presented the difference between classical and economical crime, activities which are classified as economical crime and the beginnings of fighting against it. There was also checked the connection and cooperation of the authorities who carry out criminal prosecution and its improvement. In the last part are statistical facts which are used for understanding the trend of decrease or increase of police custody, of economical crime and damage that is caused for the state.
