Abstract

POVZETEK Nesreča pri delu predstavlja vsako nesrečo, ki se zgodi pri delu ali v zvezi z delom. Vzrokov za nesreče pri delu je veliko, v osnovi pa jih lahko razdelimo na subjektivne in objektivne. Pravni viri, ki urejajo nesrečo pri delu predstavljajo skupek slovenskih in mednarodnih predpisov. Posledice nesreče pri delu so poškodbe, ki so lahko lažje, hujše, včasih žal tudi usodne. Za preprečevanje nesreč je moralno in zakonsko odgovoren delodajalec. Obveznosti delodajalca določa Zakon o varnosti in zdravju pri delu (Ur.l. RS, št. 43/2011, ZVZD-1), kot temeljni in specialni zakon. Delodajalcu zakon določa številne obveznosti kot so: ocena tveganja z izjavo o varnosti, usposabljanje delavcev, obveščanje delavcev, predhodno varstvo, promocija zdravja pri delu, določitev strokovnega sodelavca, idr. Obveznost delodajalca je hkrati pravica delavca. Položaj delavca v pravnih virih pa ni opredeljen le z njegovimi pravicami, ampak tudi z njegovimi dolžnostmi (kot npr.: upoštevanje navodil delodajalca, uporaba varnostne opreme, zdravniški pregled, idr.) V primeru, ko se delavec pri delu poškoduje, mu pripada primerna odškodnina. Predhodno je potrebno ugotoviti kdo je kriv za nesrečo, je to v celoti delodajalec s tem, ko ni sprejel ukrepov, ki mu jih nalagajo predpisi za področje varnosti in zdravja pri delu ali je k nesreči prispeval tudi delavec sam, s tem ko je pri delu ravnal neskrbno in ni upošteval delodajalčevih navodil. Odgovornost delodajalca je lahko krivdna, kar je v slovenskem obligacijskem pravu pravilo, ali pa objektivna. Zaradi škode, ki bo delavcu nastala ob nastopu nesreče pri delu, bo delavcu pripadala odškodnina za nepremoženjsko škodo, ki predstavlja le zadoščenje oz. satisfakcijo in nima pomena restitucije oz. vrnitve v prejšnje stanje, lahko pa bo delavec zahteval tudi odškodnino za premoženjsko škodo.

Secondary title: THE LEGAL STATUS OF THE WORKER IN THE EVENT OF AN ACCIDENT AT WORK
Secondary abstract: ABSTRACT Accident at work is any accident that happens during the work or related to work. There are many different causes sourcing out accident at work, but basically we can sort them on subjective and objective causes. Legalities, which determine accidents at work represents a unit of slovenian and international terms. Injuries are consequences of accident at work and may be mild, serious or even tragical. Prevention of accident is a moral and legal responsibility of the employer. Obligations of employer are determined by The Health and Safety at work Act, which is basic and special act. This act determines a number of employer's obligations, such like: risk assessment, training of workers, giving informations to workers, pre-care, health promotion at work, determining technical assistent, etc. Employer's obligations represent at the same time worker's rights, but a position of worker, in legalities, is not only determined with rights but also with obligations (respecting employer's obligations, using the protective equipment, medical examination, etc.). In case of injury at work a worker has a right to demand an appropriately damage. Before that, we have to found out, who is responsible for the accident, is it fully employers fault, by not taking measures, which determine acts for health and safety at work or did worker contributed to the accident, because his behaviour at work was negligant or he did not respect employer's instructions. The employer's liability can be culpable, which is a primary rule in Slovenian law, or objective. Generally a worker will have a right to demand a compensation for damage, which is an non-restitutional damage and represents only satisfaction and have no meaning of restitution or he will also have a right to demand a compensation for the restitutional damage.
