Abstract

Diplomska naloga je namenjena predstavitvi in preučevanju strukturnega modela preiskovalnega intervjuja. Diplomsko delo je razdeljeno na pet poglavij. V uvodu na kratek način predstavljam strukturni intervju, opredelujem teme in hipoteze, ki bodo potrjene oziroma ovržene v razpravi ter metode dela. Drugo poglavje namenjam pravni ureditvi zaslišanja v Sloveniji. Vsako zaslišanje v urejenem pravnem sistemu mora namreč potekati po zakonsko predpisanem postopku, z namenom, da se varujejo človekove pravice in temeljne svoboščine; predstavljam pogoje, ki morajo biti podani za izvedbo zaslišanja, pozornost namenjam tudi subjektom zaslišanja, kraju zaslišanja in napravam za zvočno in slikovno snemanje. Tretje poglavje zajema opis poteka zaslišanja, od samih priprav, vrste vprašanj ter metod zaslišanja. Predstavljam tudi strategije in tehnike zasliševanja, sam postopek zaslišanja, kakor tudi dokumentiranje zaslišanja. Četrto poglavje je najobsežnejše in podrobneje predstavlja faze preiskovalnega intervjuja, ki se jih policisti in kriminalisti poslužujejo pri zaslišanju preiskovanca. Peto poglavje predstavlja sklepne misli in je namenjeno preveritvi hipotez, ki sem si jih zastavila v uvodu.

Secondary abstract: The diploma thesis is aiming to present and examine the structural model of an investigation interview. The diploma thesis comprises five chapters. In the introduction, there is a short presentation of an investigation interview, the definition of the topic, a list of hypotheses, which were either confirmed or disproved in the discussion, as well as the methods. The second chapter deals with the legal regulations regarding interrogations in Slovenia. In a regulated legal system, every interrogation shall follow a legally prescribed procedure with the aim of protecting human rights and fundamental freedoms. The conditions for carrying out an interrogation are presented; special attention is paid to the interrogation subjects, the location and audio and video recording devices. The third chapter comprises the description of the interrogation process, starting with preparations, types of questions and interrogation methods. Also presented are interrogation strategies and techniques, the interrogation process itself and interrogation recording. The fourth chapter presents in more detail the stages of the investigation interview, used by police officers and criminal investigators when interrogating a subject. The fifth chapter provides some concluding statements and is used to check the hypotheses defined in the introduction.
