Abstract

Cilj posvojitve je najti otroku primerne starše, ki bodo v celoti zapolnili in nadomestili praznino od trenutka, ko so izgubili vez z biološkimi starši. Gre za zahteven proces, kjer morajo aktivno in predvsem v korist otroka sodelovati različni subjekti in pristojni državni organi. Kompleksnost postopka in izpostavljenost morebitnim tveganim situacijam pride toliko bolj do izraza v primeru meddržavne posvojitve. Ker je pravna ureditev instituta posvojitve že na nacionalni ravni v različnih državah različna, so zaradi poenostavitve postopkov in preprečitve morebitnih zlorab nujni mednarodni dogovori v obliki bilateralnih in multilateralnih sporazumov. Ker Ruska federacija ni ratificirala Konvencije o varstvu otrok in sodelovanju pri meddržavnih posvojitvah, se postopek v tej državi odvija na podlagi njihove zakonodaje. RS pa si v ta namen prizadeva z Rusko federacijo skleniti sporazum, ki bi olajšal zadeve pri zbiranju potrebne dokumentacije, poenostavil postopek v RS in uveljavil sistem neposrednega priznavanja odločb o posvojitvi, ki jih izda pristojno rusko sodišče, v RS. Kljub dražjemu postopku posvojitve otroka iz Ruske federacije, se zdi, da je več argumentov za takšno posvojitev kot proti njej. Sistem deluje, uspeh posvojitve je, ob izpolnjevanju potrebnih pogojev in predložitvi zahtevane dokumentacije, zagotovljen, poleg tega je otroka možno posvojiti v obdobju največ enega leta. Iz osebne izkušnje zakoncev, ki so v Moskvi posvojili rusko deklico, je mogoče skleniti, da je povezovanje s posvojitelji, ki so v preteklosti že posvojili otroka, in lastna iznajdljivost najboljša pot, kako priti do otroka v Ruski federaciji. Ustanavljanje institucij, ki bi posredovale med posvojitelji, centrom za socialno delo in državnimi organi v Ruski federaciji z namenom dodatne poenostavitve postopka predvsem posvojiteljem, pomeni izum birokracije in predstavlja le dodatne ovire na tej poti. Sodoben in uporabnikom prijazen sistem naj bo enostaven in pregleden. Le tako bo lahko tudi operativen in uspešen.

Secondary abstract: The main goal of adoption is to find suitable parents who will entirely fill the gap and the emptiness to children from the moment they lost their bonds with their biological parents. This is a demanding process where the active collaboration of different people and competent authorities is necessary. Complexity of this procedure and exposure to possible hazardous situations is even under closer look in case of intercountry adoption. Because of the different judicial regulation of adoption institutes on national level differs in each country. Therefore, all these procedures need international agreement in a form of bilateral or multilateral agreements to prevent possible abuses. Russian federation has not ratified the Convention of child protection and co-operation in respect of intercountry adoption, and this is the reason why the adoption procedure in Russia runs under their legislation. Republic of Slovenia is trying to reach an agreement with the Russian federation on this topic for that purpose. This would make things a lot easier if thinking of collecting the necessary documentation, and it would also simplify the procedure in Republic of Slovenia, and this would enforce the system of direct order acknowledgements in Republic of Slovenia published by authorized Russian courts. Despite the expensive procedure of adopting a child from Russian federation it seems that there are more arguments which support such adoption. System works, and adoption success is assured when facing the fulfillment of necessary conditions, and with submitted necessary documentation the child adoption takes a year at the most. From a personal experience of a married couple which adopted a Russian girl in Moscow we can conclude that the best thing is to make a connection, a bond with adopters who already adopted a child in the past, and the self-initiative with inventiveness helps to get to a child in Russian federation too. Founding institutions which have to intervene between adopters, social care center and state authorities in Russian federation with intentions of additionally simplifying the procedure for adopters only means an invention of bureaucracy that presents extra obstacles in adopters’ path. System that is contemporary and kind towards its users should be simple and clear, and it will be operative and successful only this way.
