Abstract

V diplomskem delu bomo zastopali vlogo investitorja, ki izpolnjuje pogoje za gradnjo poslovno stanovanjskih objektov. V tej vlogi se namreč vedno znova postavlja vprašanje ali je ekonomično graditi objekte za trg v vlogi glavnega izvajalca del ob angažiranju podizvajalcev, ali gradnjo prepustiti najugodnejšemu ponudniku. Za pridobitev ustreznega odgovora na to vprašanje, se morajo pripraviti aproksimativni izračuni skrčene lastne cene na podlagi popisov gradbeno-obrtniških del, oz. si pridobiti ponudbe na trgu. Ob sklenitvi gradbene pogodbe moramo preučiti pravne podlage, zakonodajne možnosti in najprimernejše oblike gradbenih pogodb. V prvem delu diplomskega dela bomo iz popisov del za poslovno stanovanjski objekt izbrali dvanajst postavk in za njih izračunali skrčeno lastno ceno s pomočjo gradbenih normativov Obrtne Zbornice Slovenije ter trenutnih tržnih cen. Oblikovano skrčeno lastno ceno bomo primerjali s ponudbenimi cenami zbranimi s ponudbami gradbenih podjetij. Z izvedeno analizo izbranih postavk bomo predstavili postopek in način izbora glavnega izvajalca za gradnjo obravnavanega gradbenega objekta. V drugem delu bomo predstavili gradbeno pogodbo s klavzulo »ključ v roke« za izbrani objekt in jo primerjali s Fidic pogodbo Srebrna knjiga. Podrobneje bomo pojasnili pojme insolventnosti, stečaja, prisilne poravnave, likvidacije ter odstop od gradbene pogodbe s strani naročnika in izvajalca.

Secondary abstract: In the thesis were presented the role of an investor who qualifies for the construction of commercial and residential buildings. In this role, is again raises the question of whether it is economical to build facilities for the market as a leading artist of the engagement of subcontractors or construction left to the lowest bidder. In order to obtain an adequate answer to this question must be prepared approximative calculations that reduced their own prices based on census building and craftworks, or. you gain market supply. At the conclusion of the construction contracts we have to study the legal basis, the legislative options, and the most appropriate forms of construction contracts. In the first part of the thesis will be part of the Census for the business-residential building chose a dozen items and for them to calculate the reduced cost price with the help of the Chamber of crafts of Slovenia and construction norms the current market prices. Shaped shrunk own price will be matched with offer prices collected offers construction companies. The analysis carried out of selected items, we will present the procedure and manner of selection of the general contractor for the construction of the building. In the second part, we present the construction contract with a clause "turnkey" for the selected object and compare the Fidic contract Silver book. We will explain in detail the concepts of insolvency, bankruptcy, receivership, liquidation, and the resignation of the construction contracts by the contracting authority and the contractor.
