Abstract

Razvoj novih, sodobnih reproduktivnih tehnik je omogočil uporabo nadomestnega materinstva, ki ga uporablja čedalje več parov, pa tudi posameznikov po celem svetu. Sedaj lahko tudi ženske brez maternice dobijo otroka, ki je genetsko povezan z njimi. V delu smo ugotavljali, kaj sploh je nadomestno materinstvo, kdo sodeluje v tem procesu ter zakaj, zakonske omejitve pri nas in po svetu in kako v tem procesu ravna medicinska sestra. Pregledali smo strokovna dela različnih avtorjev ter slovensko in tujo zakonodajo, ki obravnava to področje. Primera nadomestnega materinstva v Sloveniji nismo zasledili, v zakonodaji pa je ta praksa onemogočena. V nekaterih drugih državah je dovoljeno vsem, spet drugje je dovoljeno samo določeni populaciji, ali pa so dovoljene samo nekatere oblike nadomestnega materinstva. Medicinska sestra, ki se v tem procesu znajde, mora upoštevati vse etične in zakonodajne predpise. Tema je sicer precej raziskana, vendar se vedno znova odpirajo nova vprašanja o etični in moralni sprejemljivosti te prakse.

Secondary title: Surrogate motherhood in Slovenia and around the world
Secondary abstract: The development of new, modern reproductive technologies has enabled the use of surrogate motherhood. More and more infertile couples and individuals use this method to become parents throughout the world. With the use of surrogate motherhood, even women with absent uterus can become mothers to a child who is genetically theirs. In this thesis we were researching findings, that scholars and legislatures from different countries have published to find out what is surrogate motherhood, who participates in this process, what are their reasons to cooperate, and legal position of surrogate motherhood in Slovenian and foreign law, regarding this field. By Slovenian law this practice is disabled, so we couldn’t detect any case of surrogate motherhood. In some other countries the legislature about it is very different. In some countries it is allowed to all, while others may only be allowed to certain population, and in others only some forms of surrogate motherhood are allowed. The nurse who is involved in this process has to follow ethical and legal regulations. Although this subject has been studied by many scholars, questions about ethics and moral remain open.
