Abstract

V diplomski nalogi obravnavam institut služnosti v javno korist v teoriji in praksi. Služnost v javno korist predstavlja eno izmed oblik omejitve lastninske pravice, med katere sodijo tudi razlastitev, zakonita predkupna pravica in podobno. Služnost v javno korist je neprava stvarna služnost, ki se lahko ustanovi voljno ali prisilno. Pravna ureditev v Republiki Sloveniji pozna razlastitev, začasno ali trajno služnost v javno korist, kot oblike omejitve lastninske pravice na nepremičninah v javno korist. Služnost v javno korist se največkrat uporablja za namene gospodarske javne infrastrukture. Ustanovitev je lahko po volji lastnika nepremičnine, na podlagi pravnega posla. Lahko pa se ustanovi prisilno, z odločbo pristojnega organa. Lastnik nepremičnine, ki se s služnostjo v javno korist obremeni, ima pravico do odškodnine. Služnost v javno korist lahko preneha z odločbo upravnega organa, s potekom časa, za katerega je bila ustanovljena ali če je bila ustanovljena v korist pravne osebe, po preteku 30 let.

Secondary abstract: The thesis deals with the institutions easement of public interest in theory and practice. Easement in the public interest is one of the forms of property right restrictions, which also include expropriation, the right of preemption, and the like. An easement for the public benefit is a improper easement which may be formed voluntarily or compulsorily. The legislation of the Republic of Slovenia arrangement incorporates expropriation, temporary or permanent easement for the public benefit, as a form of restrictions on ownership of property in the public interest. Easement in the public interest is usually used for the purposes of public infrastructure. The establishment may be at the discretion of the property owner, on the basis of a legal transaction. But can also be established forcibly with the decision of the competent authority. Owner of the property that the easement in the public interest burdens, shall be entitled to compensation. Easement in the public interest may be terminated by the decision of the administrative authority, the period of time for which it was established, or if it has been established for the benefit of a legal person, after 30 years.
