Abstract

Diplomsko delo obravnava odškodninsko odgovornost zaradi mobinga na delovnem mestu. Pojav mobinga je v današnjem času vedno pogostejši, zato je potreba po dobri pravni urejenosti tega področja velika. Slovenija je trpinčenje na delovnem mestu v svojo pravno ureditev uvedla šele dokaj pozno, nekje okoli leta 2007. Tedaj je mobing uredila na različnih področjih kot so: kazensko pravo, delovno pravo in pravo človekovih pravic, glede odškodninske odgovornosti pa je žrtve mobinga napotila na splošna pravila civilnega prava. Menim, da je danes z novimi zakoni in novelami prejšnjih, področje dobro urejeno, le da se še uporabnost določb ni pokazala v praksi. V začetnem delu diplomskega dela je obravnavan pojem mobinga, opisani so vzroki, njegove posledice in faze mobinga. V drugem delu je prikazana pravna ureditev mobinga v mednarodnem in slovenskem pravu ter pravu Evropske Unije. Nazadnje pa sem obravnaval še odškodninsko odgovornost v primeru, ko je bilo dejanje mobinga že storjeno. Odškodninsko bo odgovarjal delodajalec, kar pa je le ena izmed možnosti, ki jih ima žrtev mobinga. Problema v praksi sta, da mobing ostaja skrit, predvsem zaradi strahu in nepoznavanja tematike ter zaradi nizkih odškodnin, ki ne dosežejo svojega namena, kar pa je posledica pravne ureditve na odškodninskem področju.

Secondary abstract: In my dyploma I discussed about liability for damage of mobbing at the workplace. Mobbing is nowadays becoming more and more common, so good regulation of this legal field is necessary. Regulation of mobbing in Slovenia's legal acts was introduced relatively late, somewhere around year 2007. Since then, mobbing has been regulated on different legal fields, such as: criminal law, labour law and law of human rights. For liability for damages we use general rules of civil law. I think that this particular field of law is today well regulated with new laws. Only problem is, that those rules are not yet be applied in practice. In the first part of dyploma I discussed about concept of mobbing with its causes, consequences and phases of it. The second part shows the regulation of mobbing in international, Slovenian and European Union law. Finally, I discussed about tort law, specifically about liability for damages in cases where the act of mobbing has already been done. Liability is on employer. But the tort is not an only option of the mobbing victims, they have also some requests against employer from labour law field. Main problems in practice are that mobbing remains hidden. Here are main reasons, as fear and ignorance of victim right and also low compensations in tort, which can not achieve its purpose.
