Abstract

Slovenijo je konec prvega desetletja 21. stoletja zajela globalna gospodarska kriza. Prizadevanja po omejevanju in odpravi posledic krize so terjala napore, ne samo na gospodarskem, ampak tudi na pravnem področju. Pravo socialne varnosti je samostojna pravna panoga, ki se ukvarja z urejanjem socialnovarnostnih pravic in obveznosti državljanov. Pomembno je zato, ker omogoča izvajanje dolžnosti socialne države. Gospodarska kriza je pahnila veliko število prebivalcev Slovenije v socialno stisko in povzročila znatno rast v pojavnosti števila socialnih primerov. Širitev krize na področje javnih financ Republike Slovenije je znatno otežilo izvajanje nekaterih kategorij socialne varnosti. Javne blagajne zaradi primanjkljaja niso bile sposobne vzdrževati veljavnega sistema financiranja socialnih pravic. Upoštevajoč težave, ki tudi sicer bremenijo sisteme socialne varnosti, so se izvajalci javnih služb tega področja usmerili v politiko varčevanja. Temu skladno sledi zakonodajalec z reguliranjem prava socialne varnosti. Hkrati mora jemati v ozir vse slabši socialni položaj prizadetih posameznikov in se vzdržati pretiranega poseganja v obstoječ nabor socialnih pravic. To diplomsko delo se ukvarja z determiniranjem dolžnosti socialne države ter ugotavljanjem korelacije med krizo in pravom socialne varnosti. V končni fazi predstavi nekatere zakonske spremembe, ki so rezultat prilagajanja krizni situaciji. Bralcu naj služi kot pripomoček pri raziskovanju zadevnega področja. Obseg zakonodajalčeve dejavnosti se je v času pisanja tega dela namreč stopnjeval.

Secondary abstract: During the last decade of the 21st century, Slovenia became indulged in the global economic crisis. The efforts to reduce and limit the spread of the crisis contained not only economic counter-measures, but also actions regarding the change of law. Social security law is the law which regulates the rights and obligations of citizens on the one hand, while also setting up a legal framework for the exercise of the social state duties. The economic crisis pushed many citizens into the state of social distress and caused a substantial rise in the occurrence of social cases. Gradually, the crisis spread and infected public finances sector. This in turn resulted in a detrimental worsening of Slovenia’s ability to financially sustain its social security system as public treasuries had experienced deficit. All of this, including certain omnipresent problems of the social security scheme, meant that the state and specific public bearers were forced into austerity. As a result, changes in law followed these new policies. The changes to social security have therefore gone in path of enabling a financially sustained social security system. They as well, must take into account the worsening state of afflicted individuals and should refrain from excessively reducing current rights. This degree’s substance deals with determining the duties of the social state and presenting the correlation between crisis and social security. Ultimately it presents the reader with the fundamental modifications of social security law in Slovenia. The reader should consider this writing as an instrument for further investigation of the matter at hand. The scope and dynamic nature of the legislative activity have, during the writing of this thesis, intensified. The problem with which we are dealing with, can not, nor may be subject to full analysis, while the crisis is still undergoing.
