Abstract

V diplomskem delu je opredeljen pojem smrtne kazni v Sloveniji ter po svetu. Opisali bomo tudi nastanek smrtne kazni ter njeno pravno ureditev po svetu in v Sloveniji. V Sloveniji smrtna kazen ni legalna že od leta 1989. V nadaljevanju si bomo ogledali tudi metode smrtne kazni, kot so smrtonosna injekcija, obešanje, električni stol in še druge. Pogledali si bomo tudi argumente za in proti legalizaciji smrtne kazni v naši državi. Opredelili bomo tudi dve hipotezi. V današnjem času je tema o smrtni kazni bolj odprta razpravam in raziskavam. Ljudje najdejo veliko argumentov proti in vse manj argumentov za. Smrtna kazen dobiva negativno podobo in v današnjem času daje občutek nehumanosti. Ker se družba vedno bolj razvija, s tem pa tudi zakonodaja, so mlajše generacije rojene v svetu, kjer večinoma smrtne kazni več ni. Danes je večina držav smrtno kazen odpravila zaradi nepopravljivosti in morebitnih sodnih napak. Evropa je celina z najmanjšim številom držav, ki imajo še danes legalizirano smrtno kazen. Temu je leta 1949 pripomogel Svet Evrope, ki je od svojih članov zahteval odstranitev smrtne kazni. Ta je bila odpravljena s Protokolom številka šest h Konvenciji o varstvu človekovih pravic in temeljnih svoboščin, ki zadeva odpravo smrtne kazni. Človeško življenje je nedotakljivo in zato največja vrednota. Zato ne obstajajo večje vrednote, ki bi utemeljile namerno uničevanje ljudi, vključno s smrtno kaznijo. Smrtna kazen temelji na napačni predstavi, da ima kdorkoli pravico do življenja posameznika. Nihče nima pravice odločati o cilju življenja. Človeško življenje ne more biti upravičen predmet manipulacije. Zato lahko rečemo, da je smrtna kazen nehumana in nemoralna.

Secondary abstract: In the thesis defines the concept of the death penalty in Slovenia and abroad. We describe the formation of the death penalty as well as its legal regulation in the world and in Slovenia. In Slovenia, death sentence is illegal since 1989. Below we look at the methods of the death penalty, such as lethal injection, hanging, electric chair, and others. We will also look arguments for and against the legalization of the death penalty in our country. We also define two hypotheses. In today's topic of the death penalty more open to discussion and research. People find a lot of arguments against and less the arguments for. Death penalty gets a negative image and in present times gives a sense of in humanity. As society becomes more developed and thus also law, the young generation born in a world where most of the death penalty is no longer. Today, most countries have abolished the death penalty, because of the irreparable nature and possible miscarriages of justice. Europe is the continent with the minimum number countries that have legalized today the death penalty. This was in 1949 and helped the Council of Europe, which from its members demanded the removal of the death penalty. This has been resolved with the protocol number six to the Convention for the Protection of Human Rights and Fundamental Freedoms concerning the abolition of the death penalty. Human life is inviolable, and therefore most valuable asset. Consequently there are no major values which justify the deliberate destruction of people, including the death penalty. The death penalty is based on the misconception that anyone has the right to life of the individual. Nobody has the right to decide on the goal of life. Human life cannot be justified subject to manipulation. Consequently we can say that the death penalty is inhumane and immoral.
