Abstract
Diplomska naloga "Okrožno sodišče Celje med 1924 in 1929" prikazuje delovanje kazenskopravnega sistema v Kraljevini Srbov, Hrvatov in Slovencev do uveljavitve nove kazenske zakonodaje leta 1930. V državi, ki je nastala v letu 1918, je na slovenskih tleh še vedno deloval pravni sistem Avstro-Ogrske. Drugod po državi so izvajali drugačno sodno prakso, kajti razlike med raznimi jugoslovanskimi pokrajinami so bile prevelike, da bi jih bilo moč rešiti z razširitvijo enega izmed obstoječih pravnih redov na vso državo. Po nastanku kraljevine je oblast poskušala kazensko pravo poenotiti. Začelo se je z uvajanjem IX. in X. poglavja srbskega kazenskega zakonika na ozemlju celotne države. Celih dvanajst let so potrebovali, da so sestavili kazenski zakonik, ki se je uveljavil po vsej državi. V vmesnem času, ko sta bila v veljavi oba zakonika, so vedno kaznovali z milejšo kaznijo, kajti kaznovalna politika iz srede 19. stoletja je bila mnogokrat strožja v primerjavi z novejšo zakonodajo in ni več odražala dejanskih razmer v družbi. Diplomsko delo prikazuje, kako so se spremembe na pravnem področju odražale v praksi skozi delovanje Okrožnega sodišča Celje. Pri prebiranju sodnih spisov ne moremo spregledati človeških stisk, ki so mnogokrat pripeljale do kriminala. Slabe socialne razmere, zanemarjena vzgoja, posledice vojne, duševne stiske in še mnogo drugih vzrokov je vplivalo na sojenje in mnogokrat je sodni dvor podelil manjšo kazen, kot je bila zakonsko določena.

The diploma paper "District Court Celje between 1924 and 1929" describes the operation of the criminal law system in the Kingdom of the Serbs, Croats and Slovenes until the new criminal law legislation entered into force in 1930. In the Kingdom of the SHS, formed in 1918, the Austro-Hungarian legal system was already in force in the Slovene region. In other parts of the country different judicial practices were carried out, since the differences between Yugoslavian regions were too big, to be solved simply by expanding one of the legal orders in force across the entire country. After the Kingdom of the SHS was formed, the government tried to unify criminal law. It began with the introduction of Chapters IX and X of the Serbian Penal Code across the entire country. It took an entire twelve years to compose a penal code, which would be put into force throughout the country. In the meantime, both codes were valid and milder sentences was used for punishment, as the punishment policies from the mid 19th Century were often much stricter compared to today's legislation and no longer reflected the actual social conditions. This diploma paper shows how the changes in the legal field are reflected in practice throughout the operation of the District Court in Celje. When reading the judicial records, it is impossible to overlook the difficult situations which often lead people to commit crimes. The poor social conditions, the neglect in upbringing, consequences of war, mental distress and many other conditions influenced the trials of criminal cases and the judicial court often punished the convicted with a sentence milder than the legal sentence. |
