Abstract

Policist se pri svojem delu lahko znajde v situacijah, ki od njega terjajo presojo, ki v najhujšem primeru lahko pomeni tudi razliko med življenjem in smrtjo. To je res najbolj skrajen primer. Seveda še zdaleč niso vse situacije take, je pa tudi res, da si je nemogoče predstavljati vse različne situacije, s katerimi se policist pri svojem delu lahko sreča. Od najbolj preprostih primerov, ki so tako rekoč učbeniški primeri, do popolnoma nepredvidljivih situacij, ki zahtevajo hitro in pravo reakcijo. Zato je bistvenega pomena, da je v danih, kritičnih situacijah, policist zmožen kar najbolje in pravilno odreagirati, na kar ga seveda pripravi šolanje, dodatno izobraževanje in nenadomestljive izkušnje pri delu. Tako njegove lastne izkušnje, kot vse izkušnje njegovih sodelavcev in sodelavk. Skozi leta dela na terenu, se jih nabere kar precej in poleg tega, da je prav, da se tako znanje širi, ga je pravzaprav na drugačen način, kot ravno z delom nemogoče pridobiti. V Zakonu o nalogah in pooblastilih policije, v nadaljevanju ZNPPol, je jasno opredeljeno, katera prisilna sredstva policist lahko uporabi pri svojem delu in kako naj ravna z najbolj ostro obliko prisilnega sredstva, torej s strelnim orožjem. Prisilna sredstva so namenjena obvladovanju situacije. Ker so stopnje kritičnih situacij seveda različne, torej nekatere so bolj resne, druge manj, ima policist na razpolago različna sredstva, s katerimi si lahko pomaga. To tudi pomeni, da mora za določeno situacijo uporabiti tudi primerno močno prisilno sredstvo, da bo učinek maksimalen. Zakon o policiji je bil pred kratkim posodobljen, z namenom, da ne bi prihajalo do nejasnosti pri razlagi zakona in tudi zato, ker se delo policistov tudi spreminja, to pa terja tudi nove pristope in pravila, ki jih nov zakon jasneje opredeljuje. Namesto Zakona o policiji sta sedaj v veljavi dva zakona, ZNPPol in Zakon o organiziranosti in delu policije, v nadaljevanju ZODPol, ki natančneje razlagata pravila po katerih se mora policist ravnati in tako onemogočata nejasnosti pri razlagi.

Secondary abstract: A police officer in their wordk may find themselves in situations that require a review of it which in the worst case, can mean the difference between life and death. This really is the most extreme example. Of coures, not all situatuons are like that, but it is also true that is impossible to imagine all different situations which policeman may encouter in their work. From the most simple examples, that are almost textbook examples, to the totally unforseen situations, that require quik reaction and correct reaction. Therefore, it is essential that in the critical situations a police officer is able to react appropriately, these knowledge police officer obtain in school, with additional training and with work experience. His own experience, as all the experience of his associates. Through workin years in the field, many experiences are gathered, this in the right way and also allowes, that knowledge in shared. And also, this knowledge is imposible to get in any other way. The Police Act is clearly defined which coercive means police officer may use their work and alo how to handle the most fierce form of restraint, with firearms. Coercive measures are ment to control the serious situations. The level of critical situations are of course different. Some of them are more serious than others. Therefore a police officer has at the disposal various means by which he can help himself. These also means, taht for a given situation he has to use suitable strong coercive means in order that performance in maximized. The Police Act was recently updated in order to avoid ambiguites in the interpretation of the Act and because whereas the work of police officer also varies this also demands new approaches and rules which new Police Act clearly defines. Insted of only the Police Act are now two acts. Act abaut tasks and the powers of the police and the Act on the organization and work of the police. Which more accurately interpret the commandments according to which the police officer must act in order to make it impossible for the ambiguity of interpretation.
