Abstract

Zemljiška knjiga je javna knjiga, namenjena vpisu in javni objavi podatkov o pravicah na nepremičninah in pravnih dejstvih v zvezi z nepremičninami. Temeljni predpis na področju zemljiškoknjižnega prava, ki ureja pravice in pravna dejstva v zvezi z nepremičninami je Zakon o zemljiški knjigi. Skladno s tehnološkim napredkom in informatizacijo sistema ter postopkov, je bil v letu 2011, s sprejetjem novele ZZK-1C, zaključen tudi proces informatizacije zemljiške knjige. Uvedba elektronske zemljiške knjige, uvedba elektronskega vlaganja zemljiškoknjižnih predlogov, avtomatsko dodeljevanje zadev po celotni državi ne glede na lego nepremičnine, odprava zemljiškoknjižnih vložkov in uvedba nekaterih novih materialnopravnih pojmov kot sta osnovni in širši pravni položaj nepremičnine, so nekatere najpomembnejše spremembe. S spremembami, ki jih je uvedla novela ZZK-1C, so postali postopki hitrejši, podatki, ki so vpisani v zemljiški knjigi pa so bolj ažurni in popolni, s tem pa je večje tudi varstvo strank v zemljiškoknjižnem poslovanju.

Secondary abstract: The land register is public register intended for entering and public notice of data on rights on real-estate and legal facts regarding real-estate. The Land Register Act is the basic regulation in the field of land register law which regulates rights and legal facts regarding real estate. The procedure implementing technological advances and system and procedures computerisation was completed in 2011 when Amendment 1C of the Land Register Act was adopted. Introductin of the electronic land register, electronic entering of proposals for registration of tile to land, automatic assigning of cases throughout the country, regardless of the location of the real estate, elimination of land register titles to land and introduction of some new concepts regarding substantive law, such as basic and broader legal status od the real estate, constitute some of the most important amendments. The final result of implementation of amendments stipulated by Amendment 1C of the Land Register Act are quicker procedures and more current and complete data entered into the electronic land register which also provides better protection of parties carrying out land registry operations.
