Abstract
V diplomskem delu je obravnavana tematika, ki se nanaša na premoženje zakoncev. To področje je posebej obravnavano v Zakonu o zakonski zvezi in družinskih razmerjih in spada v civilno pravo. Za premoženje zakoncev se uporabljata dva termina; skupno premoženje in posebno premoženje. Posebno premoženje je tisto premoženje, ki ga zakonec že ima ob sklenitvi zakonske zveze, in premoženje, ki izhaja iz posebnega premoženja. Skupno premoženje se pridobiva od sklenitve zakonske zveze. Za pridobivanje skupnega premoženja sta dva pogoja: obstoj zakonske zveze in da je premoženje pridobljeno z delom. Na podlagi zakona je pravna domneva, da sta deleža na skupnem premoženju enaka. V postopku razveze zakonske zveze si zakonca skupno premoženje razdelita: lahko si ga razdelita sporazumno in o tem skleneta sporazum v obliki izvršljivega notarskega zapisa ali v nepravdnem postopku, če se pa eden izmed zakoncev ne strinja z obsegom skupnega premoženja ali s pravno domnevo o višini deležev na skupnem premoženju, lahko v pravdnem postopku uveljavlja pravico do drugačne razdelitve deležev. Sodišče lahko upošteva tudi druge okoliščine, ki so vplivale na ohranitev in povečanje skupnega premoženja. Zakonca si lahko skupno premoženje razdelita tudi v času trajanja zakonske zveze.

The theme of the thesis is an analysis of matrimonial assets. This field is regulated by the Marriage and Family Relations Act and forms a part of the civil law. Two terms apply to spouse’s property: matrimonial assets and specific property. The latter is considered as property that is owned by a spouse before the marriage. Matrimonial assets are acquired from the conclusion of the marriage on, provided two conditions are met; (1) the conclusion of the marriage and (2) the assets are generated through work. The presumption under the law ensures equal shares between both spouses. In a case of divorce, the matrimonial assets are shared by the spouses. This can be done with both parties agreeing to conclude a consensus agreement in the form of an enforceable notarial deed or during non-litigious proceedings. If one spouse does not agree on the volume of his/her share of divided matrimonial assets or argues the presumption of equal shares, he/she can exercise his/her right to ask for a new allocation of shares in civil proceedings before the court. The court can also take into consideration other circumstances that lead to the preservation or expansion of the matrimonial assets. Spouses can divide the matrimonial assets already during marriage. |
