Abstract
Diplomsko delo, ki ga imamo pred sabo, obravnava sosedskopravni institut nujne poti, tako s teoretičnega vidika, kot z vidika sodne prakse. Gre za institut, s katerim v določeni meri pravno veljavno posežemo v najvišjo pravno oblast določenega pravnega subjekta nad pravnim objektom, lastninsko pravico, da bi se zavaroval interes posameznega lastnika sosednje nepremičnine zaradi njenega ekonomskega interesa in vpetosti v določen prostor, torej da bi se sosedu omogočil dostop in gospodarska raba njegovega zemljišča, ki nima direktnega dostopa do javne poti in noben drug način ni bil uspešen. Pojem lastninske pravice torej ne zajema samo pozitivna upravičenja ampak tudi negativne omejitve, kar sem skušala prikazati v svojem diplomskem delu. Ker je nujna pot po svoji vsebini stvarna služnost, v zakonu pa je nomotehnično uvrščena v poglavje o sosedskem pravu kot vrsta omejitve lastninske pravice, sem diplomo začela s predstavitvijo sosedskega prava in na kratko povzela, kaj je sosedsko pravo. Sledijo definicija, razvoj in zakonska ureditev sosedskega prava v različnih normativnih aktih. Nadaljevala sem s poglavjem o služnostih, pri čemer je glavni poudarek na stvarni služnosti. Na kratko sem opisala načela služnostnega prava, pravne podlage nastanka stvarne služnosti, prenehanje in vrste služnosti. Nekaj besed sem posvetila še zemljiški knjigi, saj ima pomembno vlogo pri ustanavljanju in prenehanju stvarnih pravic. Definirala sem pojem zemljiške knjige, čemu je namenjena, kakšne vrste vpisov v zemljiško knjigo pozna slovensko zemljiškoknjižno pravo, opisala postopek vknjižbe stvarnih služnosti v zemljiško knjigo ter navedla, katere listine so podlaga za vpise v zemljiško knjigo. V tretjem poglavju sem se lotila stvarnopravnega instituta nujne poti, njegove definicije, na kak način se ustanovi, spremeni in preneha. Diplomo sem zaključila z nepravdnim postopkom, v katerem se obravnavajo zadeve glede ustanovitve nujne poti in z vlogo na specifičnem področju strokovno usposobljenih sodnih izvedencev, bolj specifično izvedenca geodetske stroke v postopkih glede ustanovitve nujne poti. Vsakemu pomembnemu poglavju sledi sodna praksa kot primerjava, kako se obravnavana pravna pravila izvršujejo v resničnem življenju in kako se teorija kaže v praksi.

The graduation thesis in front of you discusses the neighbour law institutes of the way of necessity, both from the theoretical and from the case law point of view. It is an institute which enables us, to a degree, to legally interfere with the highest legal authority of the legal entity over the legal object, i.e. the property right, in order to protect the interest of an individual owner of a neighbouring real estate due to its economic interest and integration into a certain space, therefore to provide a neighbour with the access and the ability to use their land that otherwise has no direct access to the public path and no other method was successful. The concept of property right therefore does not include only the positive rights but also negative restrictions which I was trying to demonstrate in my graduation thesis. Since the way of necessity is, content-wise, a real easement, while the law nomotechnically categorizes it under the chapter of neighbour law as a type of property right restriction, I started out by introducing the neighbour law and adding a short description what the neighbour law actually is. This is then followed by the definition, development, and legal regulation of the neighbour law within various normative acts. The next chapter is a chapter about easements with an emphasis on real easements. Also included is a short description of the easement law, the legal basis for real easement, and the expiration and types of easements. A few words were given on the topic of land registers which play an important role in creating and expiration of real rights. The chapter also includes the concept of a land register, its purpose, the types of entries in the land registers that are used within the Slovenian land registry law, a description of the entry of real easements into the land register, and a description of which documents serve as the basis for the entry into the land register. Chapter three discusses the real institute of the way of necessity, provides its definition, the manner in which it is created, changed, and expired. The graduation thesis is concluded with non-contentious proceedings which deal with the matters regarding the creation of the way of necessity for a specific field of professional court experts, specifically a land survey expert in proceedings regarding the creation of the way of necessity. Each important chapter is followed by a court practice as a comparison, the way the considered legal rules are enforced in real life, and how the theory translates into practice. |
