diplomsko delo
Abstract
V diplomskem delu je predstavljena posebna oblika delovnega časa, torej nočno delo, z ustrezno predstavitvijo vpliva mednarodnega in evropskega prava na pravno ureditev nočnega dela, nato pa je predstavljena še podrobnejša ureditev nočnega dela v slovenski delovni zakonodaji ter spremembe in novosti na tem področju. V okviru nočnega dela, ki predstavlja institut delovnega prava, gre za delo, ki pomembno posega v človekov bioritem, hkrati pa vpliva na človekovo socialno in družinsko življenje. Ravno zaradi narave in škodljivih vplivov nočnega dela je delavec, ki tovrstno delo opravlja, upravičen do posebnih ugodnosti in dodatnih pravic. Nočnega delavca varujejo tako mednarodnopravni akti, med katerimi so najbolj značilne konvencije MOD in direktive EU kot sekundarni pravni viri evropskega prava, kot tudi nacionalna zakonodaja, v okviru katere ima v RS glavno vlogo Zakon o delovnih razmerjih, podredno pa veljajo še drugi zakoni in podzakonski akti. Poleg predstavitve relevantne delovnopravne zakonodaje s področja nočnega dela, vključuje diplomsko delo tudi problematiko v zvezi z nočnim delom oziroma odprta vprašanja, na katera sem v okviru diplomskega dela poskušal odgovoriti. Na koncu sem v diplomsko delo vključil še analizo podatkov oziroma informacij, pridobljenih na podlagi osebnih izkušenj nočnih delavcev glede vpliva nočnega dela na njihovo družbeno in družinsko življenje ter ugotovitve glede razlogov, zaradi katerih opravljajo to vrsto dela.

In the graduation thesis, a special form of working time is presented, therefore night work, with an appropriate presentation of the impact that the International and European law has on the matter’s legal regulations. Afterwards, the night work’s legal regulations in the Slovenian employment legislation are presented in detail, as well as changes and innovations in the field. The field night work, an institute of the labour law, contains work that interferes with the worker’s biorhythm and at the same time affects a person’s social and family life. These workers are entitled to special benefits and additional rights due to the nature and the harmful effects of night work. The night worker is protected by international legal acts, the ILO Conventions and the EU Directives as secondary legal sources of law are the most typical, the national legislation in which the Labour Relations Act plays the central role, and other laws and bylaws subordinate to the Act. In addition to the presentation of the relevant night work`s labour legislation, the thesis also contains issues and open questions on the subject I try to answer. Finally, I have also analysed data about the impact night work have on workers in terms of social and family life and the reason they perform this type of work, obtained from the personal experiences of night workers. |
