Abstract

Diplomsko delo je osredotočeno na obratovanje Bioplinarne Lokve pri Črnomlju, katere gradnja se je pričela leta 2006 v neposredni bližini urbanega območja, ob tamkajšnji prašičji farmi. V bioplinarni so v procesu predelave uporabljali biološko razgradljive odpadke, katerim so dodajali prašičjo gnojevko s sosednje farme. Umestitev objekta in njegovo obratovanje, pri katerem se je v okolico širil neznosen smrad, so pri ljudeh vzbudili občutke ogroženosti in nevarnosti, kar je skupaj z ostalimi motečimi dejavniki povzročilo odpor javnosti in ustanovitev civilne iniciative Društva Proteus. Pritiski javnosti in civilne iniciative so povzročili ustreznejšo odzivnost pristojnih inšpekcijskih organov Ministrstva za kmetijstvo in okolje ter Veterinarske uprave, da so izvedli ustrezne nadzore. Med opravljanjem nadzora so bile ugotovljene kršitve pri vnosu odpadnih snovi v proces predelave, kar je imelo za posledico vsebnost nevarne bakterije Salmonella in previsoko vsebnost težkih kovin v biognojevki, ki so jo trosili po kmetijskih površinah Bele krajine. Zaradi pritiskov javnosti in ugotovljenih kršitev je bil lastnik prisiljen zaustaviti obratovanje bioplinarne, ki je v letu 2013 prešla v lastništvo družbe Petrol. Z analizo delovanja bioplinarne in zakonodaje, ki uravnava in določa delovanje tovrstnih objektov, so bile ugotovljene pomanjkljivosti posameznih pravnih aktov, ki se nanašajo na gradnjo objektov in določanja posameznih mejnih vrednosti. Rešitev vprašanja bioplinarn je predvsem v spremembi zakonodaje, ki mora biti določnejša in mora omogočati tudi učinkovitejši nadzor. V tovrstnih postopkih pa bi bilo potrebno omogočiti in upoštevati tudi argumentirano delovanje civilne iniciative.

Secondary abstract: This diploma works aims to present operational activities of the Biogas Plant Lokve at Črnomelj, whose construction began in 2006 in the immediate surroundings of the urbanised area, next to the pig farm. In the processing procedure the Biogas Plant used biologically degradable waste to which they added slurry from the nearby farm. Placing the facility and its operation, producing unbearable stench, provoked the feelings of jeopardy and hazard, which – along with other disturbing factors – caused public opposition and establishment of the civil initiative, Association Proteus. Pressure from the public and civil initiative led to more appropriate responsiveness of competent inspectorate bodies of the Ministry of Agriculture and the Environment, as well as the Veterinary Directorate, to exercise control. The findings of the control activities resulted in many violations related to the input of waste substance in processing procedure resulting in the content of dangerous bacteria Salmonella and high levels of heavy metals in bio-slurry spread on agricultural areas of Bela krajina. Due to pressures from the public and identified violations, the owner was forced to stop the operational activity of the Biogas Plant that in 2013 became the property of Petrol stock company. Through analysing of Biogas Plant operational activities and legislation in the area, regulating and defining operational activities of such facilities, some deficiency of certain legal acts was established, relating to the construction of facilities and determining individual mean values. The solution of the issue related to biogas plants is especially in the changes of legislation which should be more defining and at the same time enabling more effective control. Along with that, argumented acting of civil initiative should also be enabled and considered in these procedures.
