Abstract

V magistrski nalogi je predstavljena problematika organiziranja in varovanja demonstracij. V uvodnem delu je predstavljena policija kot organizacija, sledi predstavitev in opis njenih temeljnih nalog, med katerimi je tudi pomembna naloga vzdrževanje javnega reda, ki jo v svojem 4. členu določa Zakon o nalogah in pooblastilih policije. V uvodnem delu je opisano delovanje Posebne policijske enote, saj je prav slednja tista, ki na demonstracijah zagotavlja javni red. Uvodni del je zaključen z opisom nalog, ki jih morajo policisti upoštevati pri zagotavljanju javnega reda. Osrednji del magistrske naloge se osredotoča na naloge in pooblastila organizatorja ter policije na demonstracijah, kjer so podrobno opisana pooblastila policije. Sledi kratka predstavitev področja prisilnih sredstev, ki jih lahko policija v skladu z zakonom pri svojih nalogah uporablja. Policija mora pri uporabi prisilnih sredstev spoštovati tudi temeljna načela, ki so opisana v nadaljevanju naloge. Osrednji del naloge je zaključen s pregledom zgodovine demonstracij na Slovenskem ter s podrobno analizo dogajanja na demonstracijah v letu 2012 po vseh večjih slovenskih mestih. V zadnjem delu magistrske naloge je opisana problematika spoštovanja človekovih pravic v policijskih postopkih, kar je v nadaljevanju še podrobneje razloženo s predstavitvijo mednarodnih in domačih pravnih virov. Poglavje je zaključeno z objavo celotnega intervjuja, ki je bil opravljen z vodjo Sektorja splošne policije, g. Alojzom Senčarjem. Vsebina intervjuja predstavlja popolni vpogled v pripravo policije na varovanje demonstracij, hkrati pa intervju predstavlja težave, s katerimi se policisti srečujejo v času demonstracij. V zaključku magistrske naloge so strnjene misli glede varovanja človekovih pravic in temeljnih svoboščin v policijskih postopkih. Slovenska policija je svoje delo ob varovanju množičnih demonstracij v letu 2012 opravila strokovno in profesionalno, kar je ugotovila tudi posebna delovna skupina, ki jo je imenoval generalni direktor policije.

Secondary abstract: This diploma work presents the problems of organisation and protection in demonstrations. Introductory part presents police as an organisation, followed by the presentation and description of its basic tasks, among them also the important task of maintaining public order defined in the 4th article of the Act on the tasks and authorities of police. Introductory part also presents the work of Special Police Unit which is responsible for maintaining public order in demonstrations. Introductory part is concluded with the description of tasks which policemen are obliged to obey when maintaining public order. The central part of this diploma work is focused on the tasks and authorities of the organiser and police in demonstrations, with detailed description of police authorities. Briefly are described the areas of coercive means which can be used by police according to law. When using coercive means, police has to respect also the fundamental principles described in this part. The central part is concluded with an overview on the history of demonstrations in Slovenia as well as detailed analysis of events in demonstrations in the year 2012 in all bigger Slovenian towns. In the last part of this diploma work are described the problems of respecting human rights in police procedures and additionally more precisely explained with the presentation of international and state sources. This part is concluded with the publication of an interview with the chief of General Police Sector, g. Alojz Senčar. The content of the interview presents a complete insight into the police preparation for protection in demonstrations as well as the difficulties that policemen face during the demonstrations. The conclusion of this diploma work sums up the thoughts about human rights protection and fundamental freedoms in police procedures. The work of Slovenian police in protection of mass demonstrations in the year 2012 has been fulfilled competently and professionally, which has also been stated by a special working group, appointed by general director of police.
