Abstract

Diplomsko delo Ekonomsko odvisne osebe predstavlja ureditev položaja ekonomsko odvisnih oseb, glede na zakonska določila novega Zakona o delovnih razmerjih. Ta je v slovenski pravni prostor vnesel ureditev položaja ekonomsko odvisne osebe, in sicer v 213. in v 214. členu. S sprejemom novega zakona smo tako v slovenskem pravnem sistemu dobili definicijo ekonomsko odvisnih oseb, obenem imamo uzakonjeno njihovo delovnopravno varstvo. Prvi del diplomskega dela prikazuje razvoj problematike delovnopravnega varstva v luči Mednarodne organizacije dela in v luči Evropske Unije. Sledi prikaz definicije ekonomsko odvisnega dela in obsega delovnopravnega varstva, ki so ga deležne ekonomsko odvisne osebe. V tej zvezi so v delu obravnavana posamezna vprašanja, ki jih nov zakon ne rešuje. Sledi primerjava delovnopravnega varstva ekonomsko odvisnih oseb in delovnopravnega varstva delavcev, ki je namenjena prikazu razlik v delovnopravnem varstvu. Ekonomsko odvisno delo bo potrebno razlikovati od drugih oblik opravljanja dela, zlasti od delovnega razmerja. Čeprav smo s sprejemom novega zakona dobili definicijo ekonomsko odvisnih oseb, pa vseeno nismo vzpostavili mehanizma, ki bo skrbel, da bodo ekonomsko odvisne osebe, dejansko deležne v zakonu določenega delovnopravnega varstva. Zakon namreč ne določa, kaj se zgodi v primeru, če naročnik ne podeli osebi, s katero je sklenil pogodbo o delu, statusa ekonomsko odvisne osebe. Veliko je torej prepuščenega praksi in pa novemu zakonu, ki bo urejal delo in varstvo ekonomsko odvisnih oseb.

Secondary abstract: The thesis Economically dependent persons introduces the regulation of the economically dependent persons (also called economically dependent workers) in the new Slovenian Employment Relationships Act. This Act brings the legal recognition of the economically dependent persons as a specific category in articles 213 and 214. The new Slovenian Employment Relationships Act contains the definition of the economically dependent persons, the legal characteristics of economically dependent employment and the protection measures used for it. The purpose of this thesis is to introduce the legal regulation of the economically dependent persons and to evaluate its suitability. The first part of this thesis presents the work of the International Labour Organisation and of the European Union in this area. Then the thesis presents the new slovenian legislation and protection of the economically dependent persons and talks about issues dealing with this matter, which are not resolved in the new Slovenian Employment Relationships Act. The thesis compares the legal protection of workers and the legal protection of the economically dependent persons. Economically dependent work should be recognized in practice and distinguished from other forms of work. With the new Employment Relationships Act Slovenia has the definition of economically dependent persons and the protection for them, but there is no mechanism which could achieve that the economically dependent persons will actually gain benefits from this legal protection. The new Employment Relationships Act does not contain the consequences in the case that the economically dependent persons will not get the protection as economically dependent persons. A lot of questions should be resolved in practice and in the new Act, that will refer to work and the protection of the economically dependent persons.
