Abstract

Zdravje, pravica vsakega posameznika, je ena izmed najpomembnejših vrednot, saj omogoča in zagotavlja kakovostno življenje in je temeljni vir razvoja vsake družbe. Najpomembnejše, kar pripomore k uspešnemu zdravljenju, so pristni odnosi med samimi pacienti in zdravstvenimi delavci oziroma sodelavci na posamezni zdravstveni ravni. Pacientove pravice in dolžnosti so od uveljavitve Zakona o pacientovih pravicah zbrane na enem mestu in dajejo osnovo za njihovo spoštovanje in upoštevanje v vsakdanjem življenju. Zakon o pacientovih pravicah predvideva dvostopenjski postopek reševanja sporov, ki je jasen in enostaven. Prva stopnja obravnave se izvede pri izvajalcu zdravstvenih storitev. V primeru, da stranki v postopku na prvi stopnji ne prideta do ustrezne rešitve spora, se zadeva preda v obravnavo Komisiji Republike Slovenije za varstvo pacientovih pravic, kjer je za rešitev spora predvideno več možnosti. Mednje sodi tudi izvensodna poravnava v obliki mediacije. Mediacija je postopek, v katerem tretja, nevtralna oseba (mediator) strankama, ki v tem postopku sodelujeta prostovoljno, pomaga poiskati mirno rešitev spora. Evropski kodeks etičnih načel za mediatorje vsebuje najpomembnejša načela za uspešnost in razvoj ter zaupanje v mediacijo. Pomembno vlogo na področju varovanja pacientovih pravic ima tudi Varuh človekovih pravic. Potrebe po mirnem reševanju sporov v zdravstvu naraščajo, zato sta se vodstvi Zdravstvenega doma Maribor in Univerzitetnega kliničnega centra Maribor odločili, da ustanovita skupno mediacijsko pisarno.

Secondary abstract: Health is the right of every individual and it is one of the most important values in life. It enables a high quality lifestyle and is a basic source for social development. A genuinely good relationship between patients and medical service providers, as well as between colleagues on individual medical levels themselves, contributes to successful medical treatment. Patient’s rights and duties are reviewed in the Law of patient’s rights and are a keystone for their respect and consideration in everyday life. Law of patient’s rights supports a two-levelled process to solve conflict, which is clear and simple. The first level of discussion is carried out by a medical service provider. For instance where customers are not able to resolve an issue with the medical service provider, the process is transferred to an committee of the Republic of Slovenia for protection of the patient’s rights, where more options are considered. One of the options is an out of court settlement in the form of mediation. Mediation is a process where third party individuals (mediators) provide support to customers, who voluntarily cooperate in discussion, to find a calm solution for an issue. European Code of Conduct for Mediators contains the most important principles for success, development and trust in mediation. The Human Rights Ombudsman plays an important role in protection of human rights. The need for peaceful solutions for occurring problems in health care is continuously increasing, therefore health Centre Maribor and University Medical Centre Maribor decided to establish a mediation office for common use.
