Abstract

Diplomska naloga natančneje obravnava Konvencijo o statusu begunca iz leta 1951 in Protokol o statusu begunca iz leta 1967. Konvencija je prva določila definicijo begunca in celostno uredila njegov položaj. Ker pa je veljavnost zastavila preozko, jo Protokol razširja. V nalogi je predstavljena njuna vsebinska ureditev s poudarkom na pomembnejših členih. Izključitvene klavzule določajo za katere osebe se določbe Konvencije ne uporabljajo (npr. oseba, ki je storila vojni zločin). Glede veroizpovedi je potrebno beguncem zagotoviti versko svobodo. Posebne pozornosti sta deležna tudi izvzetje od vzajemnosti in načelo prepovedi izgona in zavračanja (non refoulement). Diplomska naloga se zaključi s predstavitvijo primera iz prakse, pri katerem gre za prosilca za priznanje statusa begunca. S primerom sem se srečala v okviru projekta Amicus Curiae na Upravnem sodišču v Ljubljani.

Secondary title: The Legal Status of Refugees in International Law
Secondary abstract: The thesis focuses on the Convention relating to the Status of Refugees from 1951 and Protocol relating to the Status of Refugees from 1967. Convention gave the first definition of a refugee and regulated all aspects of his status. Because it's lack of wider validity, the Protocol was needed to expand it. We present contents of both Convention and Protocol, and emphasize articles that are more important. Exclusion Clauses define to which person the Convention shall not apply (such as a person that commited a war crime). Regarding religion the freedom of religion has to be ensured to refugees. Particular attention is given also to Excemption of Reciprocity and Non refoulement. In the end we present an example from practice, that is of an applicant for refugee status. The case was presented to us within the Amicus Curiae project at Administrative Court in Ljubljana.
