Abstract

Pomembno je, da so na položaju znotraj obveščevalnih služb ljudje, katerih namen se je boriti proti globalnim kaznivim dejanjem, terorizmu, kibernetskemu kriminalu ipd.. Ne pa nadzirati večji, če ne celo celoten spekter prebivalstva, da ne prihaja do etičnih dilem pri ljudeh na položajih. In da svojo moč, ki jim je podana izkoristijo za javno dobro, ne pa za svoje osebne predispozicije. Pomembno je, da sprejmejo odgovornost svoje službe in da si je ne prisvajajo samo zaradi moči, ki jim jo dajo podobne službe. Vse je odvisno od etičnega razmišljanja in delovanja ljudi na pomembnih položajih, ki dejansko skrbijo za varnost države pred nevarnostmi znotraj nje, kot tudi nevarnostmi zunaj nje. Tukaj naj omenim, da informacije o tem kaj dela povprečen državljan preko spleta nima nobene vrednosti, zato se v takih primerih ne bi smelo nadzirati njegovih dejanj. Nadzirajo naj se dejanja osumljencev kaznivih dejanj in ne drugih. Del diplomske naloge je ravno raziskovanje problematike omenjene v zgornjem delu besedila. Praktičen pristop vidimo skozi analizo virov raziskovanja varnosti in zasebnosti, ter analiziranja primera iz prakse, ki ga poznamo pod imenom Balkanski bojevnik. Da lahko govorimo o zakonski podlagi, moramo omeniti, da je del zaključnega dela tudi potrditev ureditve znotraj naše države, in sicer da pravna država obstaja, in s tem zapisani zakoni, ki omejujejo in predpisujejo delovanje obveščevalnih služb. Ob preučevanju tematike etičnosti in neetičnosti se dotaknemo tudi pojma pravičnosti in morale. Za na konec pa so pripomogli k zaključku diplomskega dela poleg analiziranja virov, tudi odgovori študentov Pravne fakultete in intervjuji opravljeni z osebami iz področja delovanja obveščevalnih služb. Kompilacija omenjenih metod, nam je podala marsikatere odgovore na vprašanja, na katera prej nismo znali odgovoriti.

Secondary abstract: It is important that high positions in Secret Services of Slovenia are occupied with people, which intentions are to fight against global criminal activities, like terrorism, cyber crime etc. Their idea of work should not be to control the majority or even the whole spectre of country inhabitants. It shouldn't have come to ethical dilemmas with people on best job positions. The power that is given by the nature of work they are doingm should be used for common good, and not for their personal needs. The importance is, that they accept responsibilities of their own jobs, and not to get this job, just because it grants them with some kind of power over information and using them. Everything depends on Ethical thinking and usefulness of people working on important positions. The occupied positions that states they are working for security and the best gains of country. It is important to give a notice, that what an average person is doing in their lives on the internet shouldn't be a subject of control over their doings. The actions that need to be the centre of their investigation should be the one controlled. A part of our Degree is investigating the problems mentioned above. The practical approach is seen through analysis of sources in security and privacy. We centred our intentions in practical approaches, that we did through analysing Court case called Balkanski bojevnik. To be able to talk about the law, we need to mention order of our country, which was proved that is law enforced country. With this said, it means that our written laws about Intelligence Services restrict those from doing illegal things. When mentioning Ethicalness and Unethicalness, we can not pass through term Justice and Morality, which is also mentioned in our work. So that the work looks like it should and is completed is thanks to good answers from students of Law Faculty, and to answers from interviews we made with specific people. The whole compilation has given as answers we did not know before we started doing this work.
