Abstract

Slovensko zemljiškoknjižno pravo je dolga desetletja delovalo z ustaljenimi pravili, ki so se razvijala od prvih, ročno vodenih zemljiških knjig in se ohranila vse do leta 2011. Nova zakonodajna ureditev tega področja pred 3 leti pa je dobro usidran sistem pravil postavila na glavo. Sprejeli smo sistem elektronske zemljiške knjige in se tako postavili ob bok evropskim državam, ki tovrstno tehnologijo že uporabljajo. Nov sistem je za usklajeno delovanje od zakonodajalca zahteval spremembe materialnega in procesnega zemljiškoknjižnega prava. Spremembe so prinesle veliko novega, dobrega in slabega, predvsem pri uporabi novih pravil v praksi. Pojavile so se težave na celotnem zemljiškoknjižnem področju, ki so sprva močno odmevale v slovenski javnosti, sploh v odvetniških in notarskih vrstah. Ukinitev zemljiškoknjižnega vložka in uvedba »osnovnega pravnega položaja nepremičnine« je bila premišljena poteza zakonodajalca, s katero je ustvaril povezavo med elektronsko zemljiško knjigo in drugimi nepremičninskimi evidencami. Potrebno je bilo prilagoditi še več institutov zemljiškoknjižnega prava, kot so uvedba splošne krajevne pristojnosti, uvedba obveznega vlaganja zemljiškoknjižnih predlogov po elektronski poti in še nekaj drugih. Za veliko pozitivno stvar sistema pa se je v tem času izkazal enostaven vpogled v zemljiško knjigo na portalu eZK od doma.

Secondary abstract: Slovenian land registry law worked well for long decades with established rules, that have evolved from first, hand managed land registers and survived until year 2011. The new legislative regulation, from 3 years ago, completely changed good anchored rule system. We passed electronic system of land register and placed our land registry system side to side by countries, that already use this sort of technology. For coordinated working, new system demanded by the legislature, to change substantive and procedural land registry law. Changes brought us a lot of new, good and bad, especially by using the new rules in practice. There were problems throughout the land register area, which were initially strongly echoed in the Slovenian public, mostly in the lawyers and notaries ranks. Abolition of land registry file and the introduction of »basic legal position of property« has been deliberate move of the legislature, which has created a link between the electronic land register and other property records. It was also necessary to adjust more institutes of land registry law, such as the introduction of general territorial jurisdiction, the introduction of mandatory submission of land registry proposals in electronic form and some others. Huge success of system is simple access to the land register on the website eZK.
