Abstract

Policijski postopek je sestavljen iz številnih pod postopkov, ki imajo vseskozi svojo rdečo nit, katera kaže namen zaradi katere je bilo uporabljeno določeno policijsko pooblastilo ali izvedena naloga. Ena od pomembnejših sestavin policijskega postopka je začasna omejitev gibanja, ki tisti čas omejuje svobodo gibanja državljanu v postopku. Predpostavka je, da je vsakomur, ki se znajde v policijskem postopku, za nujno potreben čas, začasno omejeno gibanje, saj brez prisotnosti osebe na kraju, tudi policisti ne morejo izvajati svojih postopkov. Zaradi tega velja ugotovitev, da je začasna omejitev gibanja nujno potrebna in neizogibna za celovito izvedbo policijskega postopka. Pravilno je tudi razlikovanje med ustavno zagotovljenima pravicama do osebne svobode in do svobode gibanja, saj ima policija zaradi tega cel nabor različnih varnostnih in procesnih pooblastil, s katerimi policisti, z relativno blagimi posegi v pravico do svobode gibanja, uresničujejo zakonsko določene naloge.

Secondary abstract: Police procedure is basically composed of a number of sub procedures which all have a common thread that indicate a purpose for which an individual police power is applied or an individual task is performed. One of the most important parts of police procedure is the temporary restriction of movement, which restricts the freedom of movement for the time that the citizen involved in the procedure. The assumption is that the movement of anyone who gets involved in a police procedure is temporarily restricted for the necessary period of time, since the police can not carry out their procedures without the presence of a person on the spot. For this reason, it is considered that a temporary restriction of movement is necessary and inevitable for the full implementation of a police procedure. It is also correct to distinguish between constitutionally guaranteed right to personal liberty and to the freedom of movement, because the police has, due to this, a whole set of various security and procedural powers, which the police officers apply to fulfil their statutory duties with relatively mild interventions to the right to freedom of movement.
