Abstract
V magistrski nalogi smo skozi aktualno zakonodajo predstavili zakonska določila na področju javnega naročanja in javnega naročanja živil. Osredotočili smo se na Uredbo o zelenem javnem naročanju (Priloga 2) in predstavili načelo kratkih verig (5. odstavek 14. člena ZJN-2). Na konkretnem primeru smo prikazali izvedbo postopka javnega naročanja živil po odprtem postopku na Višji strokovni šoli za gostinstvo in turizem Bled, izvedenem v letu 2012.
V magistrski nalogi smo predstavili problematiko izvajanja javnega naročanja na področju živil. Z uspešno izvedeno raziskavo smo ugotovili, v kolikšni meri naročniki, ki prihajajo z različnih statističnih regij Slovenije, pri oblikovanju razpisnih dokumentacij upoštevajo določila zelenega javnega naročanja in priporočila Direktorata za javno naročanje Ministrstva za finance. Ta opredeljujejo možne načine naročanja živil in napotujejo naročnike k naročanju sezonskih živil ter k uresničevanju načel tvorjenja kratkih verig v prehranski verigi, s čimer se želi povečevati delež lokalne oskrbe. Predstavili smo ključne težave naročnikov, s katerimi se srečujejo pri oblikovanju razpisnih dokumentacij.
V raziskovalnem delu smo si zastavili tri raziskovalna vprašanja, in sicer Ali naročniki pri oblikovanju razpisne dokumentacije za potrebe izvedbe javnega naročila živil upoštevajo Uredbo o zelenem javnem naročanju?; Ali obstajajo statistično značilne razlike v pokrivanju sezonskega blaga z lokalnimi pridelovalci med posameznimi regijami?; Ali uporaba 5. odstavka 14. člena ZJN-2 omogoča pokritje potreb po sezonskem blagu v celoti?
Ugotovili smo, da naročniki pri oblikovanju svojih razpisnih dokumentacij za potrebe izvajanja postopkov živil upoštevajo določila Uredbe o zelenem javnem naročanju, da med posameznimi statističnimi regijami ni statistično značilnih razlik v pokrivanju sezonskega blaga lokalnih pridelovalcev in da uporaba 5. odstavka 14. člena ZJN-2 ne vpliva na pokrivanje potreb naročnikov po sezonskem blagu v celoti.

This Master's Thesis presents the provisions of the current legislation in the field of public procurement and public procurement of foods. It is focused on the Decree on Green Public Procurement (Annex 2) and presents the principle of short chains (Public Procurement Act (ZJN-2) Article 14 paragraph 5). The implementation of the procedure of public procurement of foods is shown on the case of an open procedure at the Higher Vocational College for Catering and Tourism Bled, carried out in 2012.
This Master's Thesis presents the issue of public procurement in the field of foods. It was established on the basis of a survey to what extent the contracting authorities from different statistical regions of Slovenia apply the provisions of the green public procurement and recommendations by the Public Procurement Directorate at the Ministry of Finance when drafting the contract documents. Those provisions and recommendations define possible ways of the public procurement of foods and instruct the contracting authorities to procure seasonal foods and to implement the principle of short chains in the food chain, which should contribute to the increased share of local supply. We presented the main problems that the contracting entities are facing when drafting contract documents.
The following three research questions were posed in the research part of the Master's Thesis: Do the contracting authorities apply the Decree on Green Public Procurement when drafting contract documents for the needs of implementing public procurement of foods?; Are there statistically characteristic differences among regions concerning the coverage of seasonal goods with local producers? Does the application of the Public Procurement Act (ZJN-2) Article 14 paragraph 5 allow for total coverage of the needs for seasonal goods?
It was found out that the contracting authorities apply the provisions of the Decree on Green Public Procurement when drafting contract documents for the needs of implementing public procurement of foods; that there are no statistically characteristic differences among statistical regions concerning the coverage of seasonal goods with local producers, and that the application of the Public Procurement Act (ZJN-2) Article 14 paragraph 5 does not affect the total coverage of the needs for seasonal goods. |
