Abstract

Zasebno varstvo je panoga, ki je v zadnjih desetletjih doživela velik razcvet. Opazna so predvsem zasebnovarnostna podjetja, ki jih je čedalje več. Varnostne storitve izvaja varnostno osebje, ki ga lahko opazimo v večini trgovin, na javnih prireditvah, pri prevažanju vrednostnega blaga in marsikje drugod. Varnostniki pri svojem delu posegajo tudi v temeljne človekove pravice in svoboščine. Da bi svoje delo opravljali učinkovito in profesionalno, predvsem pa zakonito imajo določena pooblastila oz. ukrepe. Natančna opredelitev pooblastil varnostnika je zato ključnega pomena. Z zakonsko opredeljenimi pooblastili, lahko varnostniki svoje delo opravljajo zakonito, lažji je nadzor nad njihovim delom, prav tako pa so ljudje bolj seznanjeni z njihovim poklicem. Obravnavane države v diplomskem delu se razlikujejo po geografski legi, velikosti ter po razvitosti gospodarstva, zato smo želeli zvedeti ali se razlikujejo tudi glede pooblastil varnostnikov in kako so ta opredeljena v zakonodaji. Zakonodaja na področju zasebnega varovanja se med državami razlikuje, to pa velja tudi za pooblastila varnostnikov. Pričakovati je bilo, da bodo imele razvitejše države, zakonsko urejena pooblastila varnostnikov, vendar mnoge izmed njih v svojih zakonskih predpisih pooblastil sploh ne omenjajo, tako da ima marsikatera manj razvita država to področje bolje in bolj natančno zakonsko urejeno.

Secondary abstract: Private security industry has experienced a major expansion in the recent decades. It's growth is especially noticeable in the number of private security companies. We can notice security staff, who is implementing security services, in most of stores, public events, when transporting valuable goods and elsewhere. Security officers at their work interfere with the human rights and fundamental freedoms. In order to perform their work effectively, professionally and especially legally, they have certain powers or measures. The precise definition of security guards powers is therefore crucial. With legally defined powers, security guards can perform their job legally, it's easier to control their work and finally, people are more aware of their profession. The countries we have analysed in the thesis vary by geographical location, size and level of economic development, so we wanted to find out whether there are differences regarding the powers of security guards and how they are defined in the legislation. Private security legislation differs among countries and this also applies to the powers of security guards. It was expected that the more developed countries would have legally regulated powers, but most of them didn't mentioned powers of security guard in their legal regulations. Many of less developed countries have better and more precisely regulated powers of security guards.
