Abstract
V zadnjih letih je opaziti precejšen upad interesa za kmetijstvo, predvsem pri mladih. Lastniki kmetijskih zemljišč, ki jih obdelovanje zemlje ne zanima, se pogosto odločijo za prodajo le teh. Kmetijska zemljišča so zaradi svojih lastnosti za Slovenijo še kako pomembna. Prav zaradi tega zakonodajalec ni mogel dovoliti, da bi promet s kmetijskimi zemljišči potekal brez kakršnihkoli omejitev. V tretjem poglavju smo predstavili eno izmed glavnih ovir prostega prometa s kmetijskimi zemljišči, to je predkupna pravica. Kako pomemben institut je to, nam pove tudi dejstvo, da je določbe v zvezi s predkupno pravico na kmetijskih zemljiščih, mogoče zaslediti v več zakonih. Prodaja kmetijskega zemljišča brez upoštevanja predkupne pravice sploh ni mogoča. Predkupna pravica pa ni edina ovira pri prometu s kmetijskimi zemljišči. V četrtem poglavju smo opisali celoten postopek prodaje kmetijskih zemljišč. Ta zajema pridobitev potrdila o namenski rabi zemljišča, ponudbo, sprejem ponudbe, trenutek sklenitve pravnega posla, upoštevanje predkupnih upravičencev, odobritev pravnega posla s strani upravne enote, plačilo davka na promet nepremičnin, overitev zemljiškoknjižnega dovolila in vpis lastninske pravice v zemljiško knjigo. Ob pisanju smo naleteli na ne najbolj jasne in pomanjkljive določbe Zakona o kmetijskih zemljiščih. O njih smo izrazili svoje mnenje, ponekod pa smo se oprli tudi na mnenja in stališča sodne prakse.

In recent years there has been a significant drop in interest in agriculture, particularly among young people. The owners of agricultural land who are not interested in soil cultivation often prefer to sell the land rather than cultivate it. Because of its characteristics, agricultural lands are very important to Slovenia. That is why the legislator cannot afford to allow restriction free sales of agricultural land. In the third section, we present pre-emptive right which is one of the main obstacles to the free circulation of agricultural land. The provisions relating to pre-emptive rights on agricultural land take place in several laws, which indicates the great importance of the aforementioned right. Sales of agricultural land without considering the pre-emption rights is not possible. However, the pre-emptive right is not the only obstacle to the agricultural land transactions. In section four, we describe the entire process of selling an agricultural land. This includes obtaining a certificate of intended use of the land, offer, acceptance of the offer, the moment of conclusion of the transaction, consideration of pre-emption beneficiaries, the approval of the transaction by an administrative unit, payment of tax on real estate transactions, verification of a land register permission and entry of an ownership in the land register. In this thesis we encounter vague provisions of the Law on Agricultural Land. Furthermore, we express our opinion regarding shortcomings of the Law on Agricultural land and, also, in some places we rely on jurisprudential opinions and its point of view. |
