Abstract
Diplomsko delo z naslovom Ogled kraja kaznivega dejanja kot temelj iskanja materialne resnice, poudarja pomembnost ogleda, ki je v procesnem pomenu posebno preiskovalno dejanje, ki ga opravi policija ali sodišče z namenom, da se na podlagi neposrednega opazovanja ugotovijo in razjasnijo, za kazenski postopek, pomembna dejstva. Osnovni namen ogleda je, da se najdejo in zavarujejo dejstva in sledovi kaznivega dejanja z namenom razjasnitve kaznivega dejanja in odkritja storilca.
Med različnimi preiskovalnimi dejanji, ki jih morajo preiskovalci opraviti za učinkovito odkrivanje kaznivih dejanj, ima še posebej pomembno vlogo ogled kraja kaznivega dejanja, saj je velikokrat prav na kraju dejanja skrit ključ za razjasnitev kaznivega dejanja, odkritje in obsodbo storilca. Ogled se od drugih preiskovalnih dejanj loči predvsem po tem, da se pri opravljanju ogleda kraja dejanja objektivno in statično ugotavlja konkretno dejansko stanje in celoten potek kaznivega dejanja. V diplomskem delu sta primerjalno prikazani le rekonstrukcija in hišna preiskava. Kadar se ogled opravlja v zaprtih prostorih, se velikokrat postavlja vprašanje razmejitve med ogledom kraja dejanja in hišno preiskavo, ki pomeni poseg v ustavno varovane človekove pravice in temeljne svoboščine ter za izvedbo katere zakon zahteva izpolnitev določenih pogojev.
Ogled je enkratno in neponovljivo dejanje, od katerega so odvisna vsa nadaljnja opravila, zato so lahko morebitne napake usodne za nadaljnji postopek, sploh v procesnem smislu, kjer lahko pomenijo izpodbojni razlog za izločitev dokazov. Bistveno je, da se ogled kraja dejanja opravi strokovno pravilno in precizno, saj je od tega odvisna procesna vrednost materialnih sledi in predmetov, zbranih pri ogledu. Iz primerov prakse sodišč pri nas in v tujini je razvidno, kateri so nekateri pogosti problemi, ki lahko nastanejo v zvezi s forenzičnimi dokazi ter vzroki za njih.

The thesis The crime scene search as the foundation of searching the substantive truth shows the importance of the crime scene search, which is in a process scence a special investigative action, carried out by the police or court, in order to, on basis of direct observations, identify and clarify, for criminal proceedings, relevant facts.
Among the various investigative activities to be carried out by the investigators for the efficient detection of crime, has a particularly important role the crime scene search, where is often hidden the key to clarify the criminal offense and to discover and convict the offender. The main difference between the crime scene search and the other investigative actions is, that by carring out the crime scene search, the investigators objectively and staticly search to find out the actual situation and the entire course of the offense. In the thesis is presented the comparation of the crime scene search with the reconstruction and the investigation of a home. When the crime scene search is carried out indoor, often raises the question of demarcation between the crime scene search and the search of a home, which represents an intervention in constitutionally protected human rights and fundamental freedoms and for which the law requires the fulfillment of certain conditions.
The crime scene search is a unique and unrepeatable act on which depend all the furher actions, so any errors can be fatal for further proceedings, especially in procedure, where they can be a reason for exclusion of evidence. Therefore It's essential, that the crime scene search is done correctly and precisely, since the process value of the material traces and objects depends on this. From the case law of the courts in our country and abroad is shown, which are some of the common problems that may arise in the relation to forensic evidence and the reasons for them. |
