Abstract

Študentsko delo je občasno ali začasno delo, ki ga študent, dijak ali druga upravičena oseba opravlja preko pooblaščene organizacije (študentski servis, Zavod Republike Slovenije za zaposlovanje, agencije za delo) na podlagi napotnice. Gre za poseben sistem dela preko napotnic, ki ga ne pozna nobena evropska država. Mladim omogoča pridobivanje denarnih sredstev in nabiranje dragocenih neformalnih izkušenj, ki jim pomagajo pri kasnejšem vstopu na trg dela. Študentsko delo pa ima tudi nekaj negativnih strani, ki se manifestirajo v obliki zlorab, kar odkazuje predvsem na pomanjkljivo predmetno zakonodajo. Številne Vlade RS si že dlje časa želijo reformirati občasno in začasno delo dijakov in ga enotno in sistemsko urediti v novem zakonu. V prvem delu diplomske naloge sem predstavil trenutno zakonodajno ureditev občasnega in začasnega dela dijakov in študentov. Predvsem me je zanimala definicija in pravna podlaga študentskega dela. V naslednjem delu sem orisal pozitivne učinke trenutne ureditve tovrstne oblike dela, nadaljeval pa sem z izpostavljanjem problematike, ki nakazuje na slabe strani nesistemske ureditve področja. V zadnjem delu sem razdelal nekaj ukrepov, ki bi izboljšali institut študentskega dela, predvsem s poudarkom na preprečitvi zlorab in izkoriščanja študentov in dijakov. Skozi celotno diplomsko delo se dotikam tudi predlogov sprememb, ki jih je pripravilo pristojno ministrstvo v začetku leta 2014.

Secondary abstract: Student work is an occasional or temporary work by the student, college student or other person entitled to carry through authorized organizations (student work service, Employment Service of Slovenia and recruitment agencies for work) on the basis of referrals. This is a special system of work through referrals, which is not know in any other European country. It enables young people to generate cash and acquire of valuable informal experience to help them enter the labor market. Student work also has some negative sides, which are manifested in the form of abuse and this directs mainly to inadequately regulated legislation. A number of Governments have long been seeking to reform the occasional and temporary work and form and systematically arrange a new law. In the first part of the thesis I wanted to present the current legislation on occasional and temporary work of pupils and students. I am particularly interested in the definition and legal basis of student work. In the next section, I outlined the positive effects of the current arrangements of such form of work, then I continued by emphasizing the problem, indicating the shortcomings of the non-systemic regulation of this area. In the last part I pointed out several measures to improve the institution of student work, with the emphasis on prevention of abuse and exploitation of students. Over the entire thesis I have been touching the amendments presented by the relevant ministry in early 2014.
