Abstract

Diplomsko delo z naslovom Nezakonit ribolov v morskih vodah na območju Evropske unije predstavlja povezano področje (organizirane) ekološke kriminalitete in pojava nezakonitega ribolova. Glavni cilj diplomske naloge je identificirati in podrobno analizirati probleme nezakonitega ribolova kot oblike organizirane ekološke kriminalitete v morjih na območju Evropske unije z namenom iskanja predlogov rešitev. Ugotovitve, pridobljene s pomočjo analize pisnih virov, kažejo, da je obseg pojava nezakonitega ribolova v Evropski uniji skrb vzbujajoč, saj obsega 19 odstotkov prijavljene vrednosti ulovov in z leti še narašča. Gre predvsem za ribolov brez veljavnega dovoljenja, ribolov, o katerem se ne ali napačno poroča in zajema ribolovne dejavnosti, ki so usmerjene v nedorasle morske organizme ter ogrožajo obnavljanje ribjega staleža in ribolovne dejavnosti s prepovedanim ribolovnim orodjem, kar prištevamo med destruktivne oblike ribolova. V Evropski uniji so najpogostejše destruktivne tehnike ribolova lovljenje z eksplozivi, strupi, elektriko, mrežami in pastmi. Stopnja nezakonitega ribolova je najvišja v državah članicah, ki imajo najbolj bogate staleže rib, najpogosteje v kombinaciji z ohlapnim nadzorom nad ribolovnimi dejavnostmi. Te države so Danska, Francija, Italija, Poljska, Španija in Združeno kraljestvo. Posledice nezakonitega ribolova puščajo svoj pečat na okolju s izčrpavanjem ribjih staležev in pustošenjem morskih habitatov, prav tako pa je vpliv viden tudi v gospodarstvu, saj vodi v zmanjšanje dobička in izgubo delovnih mest. Evropska unija se aktivno vključuje v boj proti nezakonitemu ribolovu z izdajanjem uredb, postavljanjem pravil in organov nadzora, izvajanjem sankcij in mednarodnim sodelovanjem. Za preprečevanje in odvračanje nezakonitega ribolova bi bilo potrebno razviti še boljši nadzorni sistem, uvesti strožje sankcije, da se storilcem krivolov ne bi izplačal, ter povečati stopnjo zavedanja posameznikov o samem pojavu in njegovih posledicah, ki segajo tudi v naša življenja.

Secondary abstract: The diploma thesis titled Illegal Fishing in the European Union’s marine waters presents the connected area (of organized) ecologic criminality and the phenomenon of illegal fishing. The main goal of the diploma thesis has been to identify and analyze in details the problems of illegal fishing as a form of organized ecologic criminality in the seas at the area of European Union with the purpose to search for suggestions of solutions. The findings gained by the analysis of written sources have shown that the range of the phenomenon of illegal fishing in the European Union causes concern because it is 19 percent of the reported value of the catch and has been growing with years. It is basically fishing without legal permission, fishing which is not reported or reported in the wrong way and implies fishing activities which are focused in not fully matured sea organisms and threaten renewing the fish offspring and fishing activities with the forbidden fishing tools which can be counted as destructive forms of fishing. The most frequent techniques of fishing in the European Union have been fishing with explosives, poisons, electricity, nets, and traps. The level of illegal fishing is the highest in the member states which have the richest fish offspring, the most frequently in combination of loose control over the fishing activities. These states are Denmark, France, Italy, Poland, Spain and the United Kingdom. The consequences of illegal fishing are the environment with exhausted fish shoals and devastation of sea habitats which is also seen in economy because it leads to lower profit and loss of jobs. European Union is active in the fight against illegal fishing with passing decrees, stating rules, and institutions control, execution of sanctions, and international cooperation. However, to prevent and distract illegal fishing, it would be needed to develop better control system, introduction of strict sanctions that poaching would not be profitable for offenders and we should also increase the level of individual awareness about the phenomenon and its consequences which are important for our lives as well.
