Abstract
Ob sprejetju Zakona o pacientovih pravicah se je začela uveljavljati pravica do brezplačne pomoči pri uresničevanju pacientovih pravic, ki se izvaja preko zastopnikov pacientovih pravic. V Sloveniji imamo trinajst zastopnikov, ki delujejo na območnih izpostavah Zavoda za zdravstveno zavarovanje. Svoje delo opravljajo nepoklicno. Pri svojem delu so neodvisni in samostojni, ravnajo častno, pošteno in dobronamerno.
Naloga zastopnika je, da pacientu prisluhne in mu poda strokovno mnenje, ali je bila njegova pravica kršena ali ne. Zastopnik mora pacientu tudi razložiti, na kakšen način lahko uveljavlja svoje pravice. Pacientu na primeren način svetuje o vsebini pravic, daje konkretne usmeritve za uveljavljanje pravic in skrbi za promocijo pacientovih pravic. Nudi mu pomoč pri vlaganju pravnih sredstev po Zakonu o pacientovih pravicah.
Večinoma se pacienti nanje obračajo preko telefona ali elektronske pošte. Če zastopnik po opisu domnevne kršitve presodi, da gre za kršitev pacientove pravice, začne z neformalnim postopkom. Večina primerov se konča že na tej stopnji. Če ne najde rešitve, se postopek nadaljuje s prvo obravnavo. Če tudi tu ni rešitve, pa gre postopek pred Komisijo na Ministrstvu za zdravje.
Poleg zastopnika pacientovih pravic za pacientove pravice skrbi tudi lokalni varuh bolnikovih pravic, ustanovljen v Mestni občini Maribor, kjer deluje že od leta 2002.

Upon adoption of the Patient's Bill of Rights, the right for free assistance in exericising patient's rights was introduced, carried out through representatives of patients' rights. In Slovenia, we have 13 representatives, who work in regional branches of the Institute of Health Insurance. They work on a non-professional basis. They are independent and autonomous, and they act honestly, fairly and in good faith.
Representative's task is to listen to patients and to give them an expert opinion on whether their right has been violated or not. The representative must also explain the patient how he can exercise his rights. The representative then advises the patient in an appropriate manner on the contents of his rights, gives actual guidelines how to exercise his rights and he provides for the promotion of patient's rights. The representative offers him assistance in filing legal remedies under the Patient's Bill of Rights.
Mostly, patients turn to them via phone or e-mail. If the representative estimates – according to the description of the alleged infringement, that patient's rights have been violated, he begins with the informal procedure. Most cases end at this stage. However, if no solution is found, the procedure continues with the first hearing. If there is no solution here either, the proceeding continues before the Commission at the Ministry of Health.
Besides the representative of patient's rights, a local guardian of patients' rights was established by the Municipality of Maribor as well which has been operating since 2002 who also takes care of patience's rights. |
