Abstract
V preiskovalnih in sodnih postopkih se pogosto postavlja vprašanje verodostojnosti pričanja. V ta namen so se razvile različne tehnike in metode za ugotavljanje zavajanja in večina izmed njih več pozornosti namenja nebesednemu vedenju kot pa vsebini govora. Vendar pa obstajajo tudi metode, ki se nanašajo na besedno vedenje in ena izmed njih se imenuje Ocenjevanje veljavnosti izjav. Omenjena metoda velja za najboljšo besedno metodo preverjanja resničnosti izjav, ki ima zadovoljivo točnost in je v nekaterih državah Srednje in Severne Evrope, za razliko od Slovenije, zelo razširjena in uveljavljena. V diplomski nalogi sem predstavila teoretično ozadje metode, njeno izvedbo in veljavnost ter uporabnost v praksi. Posebno pozornost sem namenila opisu Kriterijske vsebinske analize, ki predstavlja glavni in najpomembnejši del metode in temelji na osnovni domnevi, da se resnična izjava o dogodku vsebinsko in kakovostno razlikuje od izmišljene izjave. Podrobno je tudi opisanih vseh 19 vsebinskih kriterijev, ki označujejo resničnost izjav, pri tem pa odsotnost katerega od njih ne pomeni nujno, da je izjava izmišljena. Ugotovitve raziskav pa so potrdile hipotezo, da je prisotnost kriterijev višja pri resničnih izjavah kakor pri izmišljenih.
Čeprav je bila metoda prvotno namenjena ocenjevanju resničnosti izjav otrok, domnevnih žrtev spolnih zlorab, so raziskave pokazale, da je uporabna tudi za ocenjevanje izjav odraslih in tudi v primerih, ki niso povezani s spolno zlorabo. Raziskovalci kot glavni pomanjkljivosti metode izpostavljajo različno usposobljenost ocenjevalcev in merila, po katerih odločajo, ali je pričanje resnično ali ne.

In investigative and judicial proceedings, the question of the witness credibility is often raised. Different techniques and methods were developed for detecting deceit, and most of them pay more attention to nonverbal behaviour than to speech content. Besides methods exist, which refer particularly to verbal behaviour and one of them is Statement Validity Assessment. The method mentioned is considered to be among the best verbal methods for verifying the truthfulness of statements with satisfactory accuracy. In certain countries of Central and North Europe, in contrast to Slovenia, its use is widespread and well known. The aim of this work is to present the theoretical background of the method mentioned, its application, reliability and validity in practice. Special attention is paid to the description of Criteria Based Content Analysis (CBCA) which presents the main and the most important part of the method and is based on the underlying assumption that truthful statement of an experience differs in content and quality from a statement based on invention. Our research findings show that the CBCA criteria are more often present in truthful than in fabricated statements. Although the method SVA was originally developed to evaluate the veracity of children's statements, alleged victims of sexual abuse, studies pointed out its additional use to evaluate statements of adults and in cases other than sexual abuse. The main two disadvantages are differences in qualification of CBCA coders and decision rules. |
