Abstract

Zemljiška knjiga je javna knjiga, ki je namenjena vpisu in objavi podatkov o pravicah na nepremičninah in pravnih dejstvih v zvezi z nepremičninami. Sestavljena je iz glavne knjige ter zbirke listin. Glavna knjiga je namenjena vpisu podatkov o pravicah na nepremičninah, kot tudi vpisu pravnih dejstev v zvezi z nepremičninami, za katere zakon določa, da se vpišejo v zemljiško knjigo. Zbirko listin pa tvorijo listine, ki so bile podlaga za opravljen vpis v glavno knjigo. Samo popolna zemljiška knjiga predstavlja potrebno varnost pravnega prometa nepremičnin, česar so se zavedali že v preteklosti in zaradi česar danes poznamo različne vrste vpisov. Ločimo jih na glavne in pomožne. Z glavnimi se v zemljiško knjigo vpisujejo pravice in pravna dejstva, s pomožnimi vpisi pa drugi podatki, za katere zakon določa, da se vpišejo v zemljiško knjigo. Za pridobitev lastninske pravice na nepremičninah je zraven veljavnega pravnega posla potrebna še vknjižba pravice. Listina, ki je podlaga za vknjižbo, mora izpolnjevati z zakonom določene pogoje in šele t.i. »perfektna« zemljiškoknjižna listina pridobi status intabulacijske klavzule na podlagi katere se lahko vknjižba tudi izvede. V praksi je pogosto, da listina ne izpolnjuje vseh pogojev za vpis, zaradi česar vknjižbe ni mogoče neposredno izvršiti, so se pa zato oblikovali še drugi načini, ki jih stranka v postopku lahko uporabi, da si zagotovi vpis želene pravice. Da je lahko zemljiška knjiga kar se da ažurna, so v pomoč zraven vrst vpisov tudi načela zemljiškoknjižnega prava. V današnjem času, ko smo v veliki večini odvisni od elektronskih medijev, za ažurnost skrbi popolnoma informatizirana zemljiška knjiga.

Secondary abstract: Land register is a public book which is meant for entering and publishing data about rights on real estate and legal facts concerning real estate. It consists of general ledger and collection of documents. The main book is meant for entering data on the rights to real estate, as well as for entering legal facts relating to real estate for which the law provides that land registration. The collection of documents consists of the documents that were the basis for the completed enrolment in the general ledger. Only complete land register presents the necessary legal security of property transactions, which we were already aware of in the past. Therefore we currently know different types of entries, which are divided to main and auxiliary entries. The main entries include rights and legal facts, while the auxiliary entries provide other data, which are required in the land register by the law. To obtain title to real property a valid legal transaction is still required along with entering legal rights. The document, which is the basis for the entry, must fulfil the conditions defined by the law, and only the so-called "perfect" land registry document acquires the status of land registry permit under which the booking can also be carried out. In practice it often occurs that the document does not fulfil all the conditions for the entry, hence a direct entry cannot be executed. Which is why there are other ways a party to the proceedings can use in order to secure the desired subscription rights. The principles of land registry law and the types of entries contribute to an updated land register, which nowadays, when our lives depend on electronic media, is completely computerized.
