Abstract

V diplomski nalogi je obravnavana tematike ureditve stikov otrok v vseh treh postopkih: v pravdnem in nepravdnem postopku, ki sta v pristojnosti sodišč in v upravnem postopku, kjer ima vlogo center za socialno delo. Najprej je bilo potrebno preučiti mednarodno ureditev stikov in nato še naš pravni red na tem področju. Nato sledi opis vseh treh postopkov, vloga sodišč in centrov za socialno delo ter položaj otrok in ostalih udeležencev oz. strank v teh postopkih. V nadaljevanju so opisane situacije, kjer se pravica do stikov z otrokom obravnava (razveza ali razveljavitev zakonske zveze, ločeno življenje staršev, odvzem otroka, oddaja otroka v zavod, rejništvo, odvzem roditeljske pravice in posvojitev). Na koncu sem napisala še nekaj primerov tuje in slovenske sodne prakse. Družina je tako za otroka kot za starše temelj varnosti, ljubezni, pripadnosti in kjer se ta temelj začne rušiti zaradi različnih vzrokov, lahko otroci v primeru, da starši nočejo, ne znajo ali ne zmorejo razumno odreagirati, doživljajo hude čustvene stiske, ki pustijo nepopravljive posledice za njih. Država mora za to, da bi kar se da preprečila oz. omilila te posledice, z ustrezno zakonodajo še posebej zaščititi otroke, v prvi vrsti pa je to dolžnost staršev, da ti namesto na svoje interese, gledajo na največjo korist otroka.

Secondary abstract: I discussed in my diploma survey the theme about children's contacts regulations in all three procedures: in civil procedure and non-contentious procedure, which are in jurisdiction of courts and in administrative procedure, where the social work centre is responsible. At first, it was necessary to learn about international regulation of contacts and then about our law in this area. Next, there is a description of all tree procedures, the role of courts and social work centres and the position of children and other participators or parties in these procedures. In continuation, there are presented situations, where is the right of child's contact treated (divorce or invalidation of marriage, separate living of parents, dispossession of child, putting the child in reformatory institution, foster care, taking the parental rights and adoption). For the end I wrote some examples of foreign and Slovenian case law. Family is for a child and for parents the base of security, love, belonging and where this base starts to demolish because of different causes, when children in case that their parents do not want, or can not respond reasonable go through emotional crisis, which leaves irreversible consequences for them. The state must prevent or alleviate this consequences with appropriate legislation that especially protects children, but principally this is parents's obligation. They should protect children's benefit at any time, instead looking only on themselves.
