Abstract

Republika Hrvaška se je z vstopom v Evropsko unijo zavezala, da bo v celoti prevzela schengenski pravni red. Ko bo le-tega prevzela v celoti, se bo schengenska meja prestavila na ozemlje Republike Hrvaške, zaradi česar bo posledično prišlo do ukinitev mejnih prehodov med Republiko Slovenijo in Republiko Hrvaško. Slovenija se bo ob tem morala spopasti s problemom čezmejnega kriminala na vlaku, ki bo dobil prosto pot v Slovenijo in v vse evropske države. Po odpravi mejnega nadzora na vlaku bo nastal varnostni primanjkljaj, pretok oseb in blaga pa bo nenadzorovan. Iz preteklih izkušenj domnevam, da bi storilci kaznivih dejanj takšno situacijo takoj začeli izkoriščati, zato obstaja velika verjetnost, da bi po ukinitvi mejnih nadzorov prišlo do povečanja števila kaznivih dejanj na vlaku. V diplomskem delu so analizirani statistični podatki o kaznivih dejanjih za Postajo železniške policije Ljubljana (od 2000 do 2007) in Postajo mejne policije Dobova (od leta 2003 do leta 2013). Cilj analize je bil ugotovitev porasta in/ali upada obravnavanih kaznivih dejanj obeh postaj, vrste in državljanstva storilcev kaznivih dejanj ter primerjava med postajama. Na podlagi ugotovitev je mogoče domnevati, da bo po vstopu Republike Hrvaške v schengensko ozemlje, ko bo mejni nadzor ukinjen, prišlo do povečanja čezmejne kriminalitete, zato bi bila smotrna ustanovitev policijske postaje, ki bi delovala samo na vlakih. Slednja bi lahko nadzor opravljala na območju celotne Slovenije ali pa samo na območju določene policijske uprave. Delo na vlakih bi lahko opravljali policisti Postaje mejne policije Dobova, ki so v Sloveniji trenutno najbolj usposobljeni policisti za izvajanje policijskih postopkov na vlakih.

Secondary abstract: Upon its accession to the European Union, the Republic of Croatia undertook to adopt the Schengen acquis in full. Once the Schengen acquis has been fully implemented, the Schengen border will be moved to the territory of the Republic of Croatia and border controls at crossings between the Republic of Slovenia and the Republic of Croatia will be lifted. Slovenia will be faced with the problem of increased cross-border crime on trains, as the perpetrators of such crimes will have a clear path to Slovenia and all other European countries. The abolition of on-train border checks will therefore result in a lack of security, as the flow of people and goods will go unmonitored. Based on past experience, it is reasonable to assume that criminals will begin to exploit this situation immediately. It is therefore highly likely that there will be an increase in on-train crime. In diploma are analysed statistical data on criminal offences for Ljubljana Railway Police Station (from 2000 to 2007) and Dobova Border Police Station (from 2003 to 2013). The main goal was to find out increase and/or decrease of treated criminal offences of both stations, types of crime and citizenships of crime offenders and comparison between stations. Based on the analysis we can suppose that with entry of Republic of Croatia into the Schengen territory, when border control will be abolished, will increase cross-border crime. The solution can be foundation of police station that would work only on trains. The police station could do supervision on the range of entire Slovenia or only on the range of certain police administration. Police officers from Border police station Dobova could do the supervision on trains, because they are the most qualified for procedures on trains in Slovenia at the moment.
