diplomsko delo
Abstract
V opravljanju zdravniške dejavnosti prihaja redno do napak v postopku, diagnozi ali samem zdravljenju. Naloga prava je v teh primerih, da določi, katere povzročene napake so pravno nedopustne oziroma kaznive in kakšne pravne sankcije doletijo izvršitelja. Inštitut kazenskega prava tako poskuša nuditi uteho oškodovancem ter hkrati deluje preventivno, saj želi takšne nedopustne napake preprečiti. V diplomski nalogi bom skozi sedanjo in prejšnjo kazensko zakonodajo predstavila sankcije pri zdravniških napakah in sistem reguliranja tega področja. Predstavila bom, kako in, predvsem, s katerimi zakoni in predpisi zakonodajalec ureja področje in kateri organi pri tem vse sodelujejo.

Secondary abstract: |
When practicing a medical profession mistakes regularly occur, i.e. procedural, diagnostic or mistakes in treatment. It is the task of the law to determine which of these mistakes are legally inadmissible or a criminal offence and which legal sanctions shall be imposed on the culprit. Thus, the criminal law institute attempts to offer consolation to the injured party and simultaneously act in a preventive way to prevent such legally inadmissible mistakes. In the diploma paper, sanctions with medical malpractices as well as the regulative system in this area will be presented through the current and former criminal justice system. In addition, how are foremost with which laws and regulations the legislator regulates this field and in cooperation with which bodies will be presented. |
