Abstract

Varovanje zdravja ljudi je vrednota, ki jo Evropska unija (odslej EU) spoštuje in v ta namen prilagaja svojo zakonodajo. Obseg ukrepanja EU na področju zdravstvene politike je določen s Pogodbo o delovanju EU (odslej PDEU). EU varuje zdravje tako, da dopolnjuje nacionalno politiko držav članic s pravnimi akti, raziskavami s tega področja in sodno prakso Sodišča EU. Zelo pereč problem v EU so namreč kronične nenalezljive bolezni, ki so pogosto rezultat nezdravega prehranjevanja in uživanja alkoholnih pijač. Te bolezni pa vodijo k večjim socialnim in ekonomskim stroškom. Zato v diplomskem delu analiziram vrsto določb, ki urejajo trženje alkoholnih pijač in nezdrave hrane otrokom v EU. V diplomskem delu najprej predstavim splošni pravni okvir glede trženja blaga in storitev, nato pa še konkretne ukrepe EU, v smislu direktiv in sodne prakse Sodišča EU s področja trženja alkoholnih pijač in nezdrave hrane otrokom. Poleg tega na podlagi načela nujnosti in sorazmernosti predstavim razmerje med pravicami otrok, kot skupine potrošnikov in pravicami ponudnikov industrije. Diplomsko delo zaključim z ugotovitvami in načelom subsidiarnosti med nacionalnimi sistemi in EU, ki bi lahko pomagalo uresničiti postavljeni cilj, tj. zaščititi otroke pred trženjem alkohola in nezdrave hrane.

Secondary title: PROTECTING CHILDREN FROM ALCOHOL AND UNHEALTHY FOOD MARKETING IN EUROPEAN UNION
Secondary abstract: Protecting human health is a value considered by the European Union (from now EU) and according to this, it adjusts its legislature. The scope of EU working on health politics is defines by the The Treaty on the Functioning of the European Union (from now on TFEU). EU protects human health by complementing national politics of Member States with legal acts, by further researching this field and Court’s cases. In the EU, there is a very serious problem of chronic non-communicable diseases which are often result of an unhealthy diet and consumption of alcoholic beverages. These diseases lead to greater social and economic costs. Firstly, in diploma thesis, I discuss legal framework in marketing of goods and services. Afterwards, I concretely analize the work of EU, their directives and Court’s cases regarding marketing of alcohol beverages and unhealthy food for children. Beside that, I represent the relationship between children’s rights as the group of consumers and rights of industry which is based on the principle of proportionality. I conclude the diploma thesis explaining the principle of subsidiarity between national laws and EU that could help to reach the goal which is protecting children from the marketing of alcoholic beverages and unhealthy food.
