Abstract
Inšpekcija za okolje in naravo deluje kot organ v sestavi Ministrstva za kmetijstvo in okolje. Naloge inšpekcijskega dela oziroma nadzora izvajajo okoljski inšpektorji. Okoljski inšpektorji izvajajo nadzor nad določbami številnih okoljskih predpisov, tako pri pravnih kot tudi pri fizičnih osebah. Okoljski inšpektorji izvajajo nadzor na podlagi Zakona o inšpekcijskem nadzoru (ZIN, 2007), v katerem so določena načela inšpekcijskega nadzora, kot tudi kakšna pooblastila imajo inšpektor, njegove pravice in dolžnosti, prav tako pa tudi organizacijo inšpekcije same ter njihov položaj.
Iz leta v leto postajajo odpadki v okolju bolj pereč problem. Zaradi vse večjega števila okoljskih predpisov, kot tudi kršiteljev le-teh, postajajo okoljski inšpektorji vse bolj obremenjeni. Leta 2005 so tako okoljski kot tudi drugi inšpektorji pridobili pooblastilo za vodenje in odločanje v prekrškovnih postopkih, kar je dodatno obremenilo okoljske inšpektorje. Namen diplomskega dela je bil analizirati in predstaviti predloge, ki bi pripomogle k večjemu nadzoru večkratnih kršiteljev, s tem pa tudi zmanjševanju negativnega vpliva na okolje. V diplomskem delu je predstavljeno delo in pristojnosti okoljske inšpekcije kot tudi delo ter pooblastila glavnega inšpektorja, okoljskih inšpektorjev in nadzornikov. V zaključku so predstavljene izboljšave, ki bi lahko pripomogle k bolj učinkovitem delu okoljskih inšpektorjev, s čimer bi se zmanjšal negativen učinek na okolje in povečal nadzor nad večkratnimi kršitelji. Iz ugotovitev je razvidno, da okoljski inšpektorji podpirajo vzpostavitev enotne evidence kršiteljev, saj bi tako imeli večji nadzor nad ponavljajočimi se kršitelji. Prav tako podpirajo idejo o stopnjevanju višine izrečene globe za ponavljajoče se kršitelje. Za rešitev obstoječih problemov pa je najprej potrebna sprememba Zakona o prekrških ter vzpostavitev evidenc vseh kršiteljev, ki se pojavljajo kot zavezanci v postopku.

Inspectorate for the Environment and Nature works within the Ministry of Agriculture and the Environment. The tasks of inspection and control work are carried out by environmental inspectors. Environmental inspectors oversee the provisions of a number of environmental regulations, with both legal and natural persons. Environmental inspectors carry out surveillance on the basis of the Inspection Act (ZIN, 2007), which sets out the principles of inspection, as well as what power the inspector has, his rights and duties, as well as the organization of inspections themselves and their situation.
Year by year, environmental pollution is becoming a pressing problem. Due to the increasing number of environmental regulations, as well as violators of these, the environmental inspectors are becoming increasingly overwhelmed. In 2005, both environmental as well as other inspectors obtained an authorization for management and decision-making in offense proceedings, which is an additional burden for the environmental inspectors. The aim of the diploma thesis was to analyze and present proposals which would contribute to the control of multiple offenders, while also reducing the negative impact on the environment. This thesis presents the work and responsibilities of environmental inspections, as well as the work and the powers of the Chief Inspector, environmental inspectors and supervisors. This thesis presents the improvements that would, in my opinion, contribute to a more efficient work of environment inspectors, thereby reducing the negative impact on the environment and to increase supervision over multiple offenders. The key findings show that environmental inspectors support the establishment of a single record of offenders, which would also give them greater control over multiple offenders. Also, they support the idea of increasing the amount of the fine imposed for repeated violations. In order to step forward to solving the existing problems, there needs to be a change in regulations and the establishment of records of all offenders who appear as person liable in the process. |
