Abstract

Pri preiskovanju in odkrivanju kaznivih dejanj ima veliko vlogo tudi odkrivanje in ugotavljanje laži, kajti na podlagi ugotavljanja določenih resničnih ali neresničnih informacij lahko sklepamo o samem kaznivem dejanju, poleg tega imajo informacije, ki so bodisi resnične ali ne, velik pomen pri samem poteku preiskave. Ena izmed tehnik, ki lahko pripomore k učinkovitejšemu preiskovalnemu delu, tako na področju policijskega zaslišanja in informativnega pogovora, kot na področju odkrivanja laži, je tehnika nevro-lingvističnega programiranja, ki lahko omogoča učinkovitejše pridobivanje informacij v samem preiskovalnem postopku in morebiti tudi ugotavljanje in odkrivanje laži na podlagi očesnih premikov. Poleg tehnike NLP lahko kot orodje za odkrivanje laži uporabimo tudi ocenjevanje in vrednotenje verbalne ter neverbalne komunikacije in na podlagi informacij, ki jih pridobimo na podlagi določenega vedenja, lahko sklepamo ali je določena informacija verodostojna ali ne. Ker rezultati raziskav ne dajejo najbolj relevantne slike o tehniki NLP in na podlagi očesnih premikov ne moremo z gotovostjo sklepati ali nekdo laže ali ne, poleg tega ne obstaja noben nevtralni znak, na podlagi katerega bi lahko sklepali ali nekdo laže ali ne, ne moremo govoriti o objektivnosti tehnike NLP, pa vendar lahko služi kot orodje za iskanje ostalih dokazov, ki lahko vodijo do uspešnega zaključka raziskave. Podobno velja tudi za ugotavljanje laži na podlagi neverbalne komunikacije, kajti zaradi kompleksnosti človeškega vedenja, osebnih lastnosti ter vpliva okolja, ne moremo z gotovostjo trditi o verodostojnosti izjave, vendar lahko pa na podlagi določenih informacij, ki jih razberemo iz govorice telesa, usmerjamo preiskavo na tak način, ki vodi do uspešnih rezultatov.

Secondary abstract: Lies detection plays an important role to investigation and detection crimes because the crimes can be deduced on the basis of certain truth or false information, after all, the information that are either true or not have major importance in the very course of the investigation. One of the techniques that can help to strengthen the investigation in the field of police hearings, informative conversation and in the field of lies detection is a technique of neuro-linguistic programming, which may allow a more efficient acquisition of information in investigative proceeding and possibly allows lies detection on the basis of eye movements. Beside the NLP technique as a lie detection tool there is also a possibility to use a evaluation of verbal and non-verbal communication and information that are acquired on the basis of certain behavior to detect leis or to determine infomation as authentic or not. As the research results do not provide the most relevant picture of NLP technique and on the basis of eye movements we cannot confidently conclude whether someone is lying or not, moreover, there is no neutral sign of lying which may lead to conclusion whether someone is lying or not, we can not talk about the objectivity of NLP technique. On the other hand NLP technique can be used as a tool for searching other evidence that may lead to the successful completion of investigation. There is a similar applies to the detection lies on the basis of non-verbal communication, because of the complexity of human behavior, personal characteristics and environmental impact, we cannot confidently assert about authenticity of statements, but on the basis of certain information that are figured from body language the investigation could be directed in such a way which may leads to a successful conclusions.
