Abstract

Prenehanje zakonske zveze (razveza ali razveljavitev) prinaša določene pravne posledice. Med temi je tudi preživnina, ki jo lahko zahteva nepreskrbljeni zakonec oz. partner. Preživnina je denarni znesek, ki se izplačuje periodično in pokriva življenjske stroške upravičenca (nepreskrbljenega zakonca). Ureja jo Zakon o zakonski zvezi in družinskih razmerjih. Dolžnost preživljanja med zakoncema je izvedena iz pravnega temelja dolžnosti vzajemne pomoči. A zanjo morajo biti izpolnjeni zakonski pogoji. O preživnini odloči sodišče v postopku razveze zakonske zveze ali na podlagi tožbe upravičenca. Določi se glede na potrebe upravičenca in zmožnosti zavezanca. Višina preživnine se usklajuje enkrat letno, in sicer v mesecu marcu, na podlagi količnika uskladitve preživnin. Zakonec pa ni dolžan preživljati drugega zakonca, če bi bilo s tem ogroženo njegovo lastno preživljanje ali preživljanje mladoletnih otrok, ki jih je po zakonu dolžan preživljati. Zakonca se lahko o preživnini v primeru razveze tudi pisno sporazumeta. Višina preživnine pa se lahko kasneje tudi spremeni. Prav tako se lahko določi le za določen čas. Preneha pa, če se spremeni premoženjski položaj prejemnika oz. upravičenca do preživnine. Možna je tudi odpoved pravici do preživnine. Enako oz. podobno velja tudi v primeru prenehanja oz. razveze zunajzakonske skupnosti, kakor tudi v primeru prenehanja registrirane istospolne partnerske skupnosti. Od leta 2008 je neplačevanje preživnine v Republiki Sloveniji kaznivo dejanje po Kazenskem zakoniku. Sodna praksa s področja preživnin je v Republiki Sloveniji dokaj bogata.

Secondary title: MAINTENTANCE AFTER THE TERMINATION OF PARTNERSHIP
Secondary abstract: The termination of a partnership (eg. divorce or annulment) brings certain legal consequences. Among them, there is maintenance which may be demanded by the dependent spouse or partner. Maintenance is the amount of money which is paid periodically and covers the living expenses of the beneficiary (dependent partner). It is regulated by the Law of Marriage and Family Relations. The obligation of maintenance between spouses is derived from the legal basis for mutual assistance obligations. But some legal conditions must be fulfilled. The maintenance is decided on by the court in a divorce proceeding or on the application of the beneficiary. It is determined according to the needs of the beneficiary and the capabilities of the debtor. The amount of maintenance is adjusted once a year, in March, based on the quotient of harmonization of maintenance. But the partner is not obliged to provide for another partner if his own livelihood or maintenance of minors (whom he or she is legally obliged to maintain) is undermined. The partners (eg. the spouses) may also agree on maintenance by a written agreement in the event of a divorce. The amount of maintenance can be changed later. It can also be determined for a limited period of time. It stops if the financial situation of the recipient or the beneficiary is changed. The beneficiary can also renounce maintenance. The same or a similar regulation applies also in the event of a termination of cohabitation, as well as in the event of a termination of the registered same-sex partnerships. Since 2008, non-payment of alimony in Slovenia is a criminal offense under the Criminal Code. Jurisprudence in the field of maintenance is quite rich in the Republic of Slovenia.
