Abstract
Lastninska pravica je temeljna človekova pravica, ki jo je zakonodajalec v 37. členu SPZ opredelil kot pravico imeti stvar v posesti, jo uporabljati in uživati na najobsežnejši način ter z njo razpolagati. Njena vsebina pa se oblikuje tudi skozi njene omejitve. Omejitve uporabe, uživanja in razpolaganja lahko določi le zakon.
Omejitve lastninske pravice so v današnjem svetu nujne zaradi sožitja v družbi. Zaradi varovanja gospodarske, socialne in ekološke funkcije lastninske pravice so potrebne javnopravne omejitve. Izhodišče za omejitev lastninske pravice zagotavlja 67. člen Ustave Republike Slovenije.
Javni interes opravičuje omejitve in mora biti izkazan pri posegih v lastninsko pravico. Poseg v pravico pa mora biti minimalen, večji obseg namreč predstavlja kršitev veljavnega prava in tudi možnost varstva po veljavnem pravu.
V slovenskem pravnem redu obstaja vrsta omejitev lastninske pravice na nepremičninah v javno korist, ki so poleg temeljnega Zakona o urejanju prostora razpršene po številnih področnih zakonih.
Posegi države v lastninsko pravico posameznikov so vedno močnejši, s čimer nam kmalu postane jasno, da naša lastninska pravica nikakor ni absolutna in neomejena.

Property right is fundamental human right and is defined by Article 37 of Slovenian Property code as »the right to have an object in possession, to use and to enjoy it in the most comprehensive manner and as well to dispose.« The content is also formed through its limitations. Restrictions on the use, enjoyment and disposition can be determined only by the law. In modern world restrictions on property rights are essential, especially due to coexistence in society. Restrictions of property right in public interest are necessary for the reason of protection of economic, social and ecological function of property right. The foundation of restrictions of property right in public interest is Article 67 of the Constitution of the Republic of Slovenia. Limitations are justified by the public interest, which must be demonstrated in encroachment on property right in particular case. Interference with the right must be minimal; a wider range constitutes an infringement of applicable law and in this case, there is a possibility of protection under existing law.
Slovenian law provides a variety of restrictions in the public interest. They are settled by the Spatial Planning Act and are extra regulated by seectoral laws.
Since governmental interventions into the right of property are becoming more significant, it soon becomes very clear that our property right cannot be absolute and unlimited. |
