Abstract

Diplomska naloga se ukvarja z moralnimi pomisleki, ki se nanašajo na patentiranje biotehnoloških izumov. Prikazana je podrobna analiza 53. člena Evropske patentne konvencije, ki od patentiranja izključuje izume, katerih gospodarsko izkoriščanje bi bilo v nasprotju z javnim redom ali moralo. Analiza temelji na obravnavi najpomembnejših in najspornejših patentnih zahtev, ki so se znašle pred tehničnim ali razširjenim odborom za pritožbe Evropskega patentnega urada. Leta 1998 je bila na ravni Evropske unije sprejeta tudi Direktiva 98/44/ES o pravnem varstvu biotehnoloških izumov, ki pomembno dopolnjuje Evropsko patentno konvencijo in je predmet obravnave v 5. poglavju. Kot primerjava z evropskim patentnim režimom je prikazana tudi praksa Ameriškega urada za patente in blagovne znamke ter najpomembnejša stališča ameriških sodišč pri obravnavi patentov iz področja biotehnologije. V 7. poglavju so podani še nekateri glavni pomisleki o biotehnologiji ter rešitve, ki bi lahko biotehnološke patente rešile nekaterih najostrejših kritik.

Secondary title: MORAL ASPECTS OF PATENTING BIOTECHNOLOGICAL INVENTIONS
Secondary abstract: Thesis deals with moral issues that are related to patent protection of biotechnological inventions. It analyses Article 53 of European Patent Convention that excludes patent protection for inventions, which exploitation would be contrary to ordre public or morality. Analysis is based on case law that has been established by European Patent Office. Cases that are analysed are known to be morally most controversial and decisions made by technical and enlarged boards of appeal are taken into consideration. In 1998 European Union has adopted the Directive 98/44/ES on legal protection of biotechnological inventions that has served as a useful means of complementary interpretation for European Patent Convention and is discussed in chapter 5. For purposes of comparison, paper shows some decisions made by United States Patent and Trademark Office and some most important judicial decisions ruled by Courts of United States of America. Chapter 7. deals with some basic concerns that are related to biotechnology and suggests some solutions, that could free biotech patents from most severe criticism.
