Abstract

Diplomska naloga obravnava postopek pred Stalnim mednarodnim kazenskim sodiščem (v nadaljevanju Mednarodno kazensko sodišče, MKS). Mednarodno kazensko sodišče, ki je bilo ustanovljeno na podlagi Rimskega statuta, pogodbe, ki je bila sprejeta 17. julija 1998 v Rimu na diplomatski konferenci, je kot prvo stalno mednarodno kazensko sodišče pristojno za vodenje preiskav in sodnih postopkov zoper posameznike, osumljene najresnejših mednarodnih zločinov, kot so genocid, hudodelstva proti človeštvu, vojna hudodelstva in hudodelstvo agresije. V skladu z obravnavano tematiko je tako predstavljena pristojnost, sestava in delovanje Mednarodnega kazenskega sodišča. Podrobneje so prikazane posamezne faze postopka pred Mednarodnim kazenskim sodiščem, kazenske sankcije, izvrševanje kazenskih sankcij, sodelovanje držav z Mednarodnim kazenskim sodiščem in njihova vloga pri izvrševanju kazenskih sankcij sodišča ter pravna sredstva, ki so strankam na voljo v postopku pred Mednarodnim kazenskim sodiščem.

Secondary abstract: This thesis discusses the procedure before the International Criminal Court (ICC). The International Criminal Court, which was established by the Rome Statute of the International Criminal Court, the treaty that was adopted on July 17, 1998 at a diplomatic conference in Rome, is the first permanent international criminal court with jurisdiction to prosecute individuals accused of some of the most serious international crimes, such as genocide, crimes against humanity, war crimes and crime of aggresion. In accordance with the subject matter the following thesis presents a jurisdiction, composition and administration of the International Criminal Court. In detail is shown each stage of the proceedings before the International Criminal Court, penalties, enforcement of penalties, cooperation of states with the International Criminal Court and their role in the enforcement of the penalties of the Court and remedies that are available in proceedings before the International Criminal Court.
