Abstract

Lobiranje ima dolgoletno tradicijo in se nekoliko razlikuje od države do države, zaradi razlik v tradicijah in političnih sistemih. Sam pojem lobiranja ni tako enostaven, kot se morda na prvi pogled zdi. Kot aktivnosti, katerih namen je vplivati na javne organe s posebnim poudarkom na člane zakonodajnega telesa, promoviranje in zagotavljanje sprejetja določene zakonodaje z vplivanjem na javne organe in tudi poskusi spodbujanja javnih organov k določeni aktivnosti. V družbenem smislu predstavlja lobiranje dejansko sestavino vsakega demokratičnega zakonodajnega in političnega procesa. Proces lobiranja je tisti del vplivanja na odločevalce, ki se odvija med lobistom in je odločevalcem skrit pred očmi javnosti. Kljub stoletni tradiciji za posamezne primere ni natančno predpisan. Lahko je povsem preprost ali pa večplasten in zapleten. Predvsem želim predstaviti dejstva, ki jih je potrebno upoštevati pri načrtovanju in izvedbi lobistične kampanje, da bi le-ta prinesla želene rezultate. Pravilno načrtovanje strategije in taktike lobiranja namreč močno poenostavi razumevanje lobiranja kot procesa pogajanj. Lobiranje je lahko učinkovito le s pravilno zastavljenimi in izpeljanimi postopki, ki morajo biti usmerjeni v pravo ciljno publiko in prave politične odločevalce. Za to pa so potrebna različna znanja, veščine, metode in tehnike lobiranja, ki jih mora poznati vsak lobist. Samo pravilno postavljena strategija in dosledna izpeljava lobističnih procesov so ključ do želenih ciljev, dogovorjenih med lobistom in njegovim naročnikom. Pravno-formalna ureditev lobiranja lahko zagotovi, da bo lobiranje transparentno in bo zagotavljalo dopustno in želeno delovanje lobistov ter organizacij, povezanih z lobiranjem. Zato je nujno potrebno, da se v EU izpeljejo aktivnosti za ustrezno pravno ureditev področja uveljavljanja interesov na eni strani in delovanja odločevalcev na drugi strani. Lobiranje je tako nujno potrebna demokratična dejavnost, ki ob ustrezni pravni regulaciji, z močjo argumentov, zagotavlja širši vidik demokracije v interesu javnosti.

Secondary title: LOBBYING REGULATION IN SLOVENIA AND IN COMPARATIVE LAW
Secondary abstract: Lobbying has a long tradition and differs slightly between countries due to different traditions and political systems. The concept of lobbying itself is not as simple as it may seem. It includes activities with the objective of influencing public authorities, focusing particularly on legislative body members, promoting and securing the adoption of specific legislation and attempting to steer public authorities towards specific activities. From the social point of view, lobbying represents an integral part of any democratic legislative and political process. The lobbying process is the part of influencing the decision makers carried out by the lobbyists which is hidden from the public eye. Despite hundreds of years of tradition, it is not defined in detail for specific cases. It can be quite simple or layered and complex. My first objective is to present the facts that should be considered in planning and carrying out a lobbying campaign in order for it to yield the desired results. Planning the lobbying strategy and tactics correctly can immensely simplify the understanding of lobbying as a negotiation process. Lobbying can only be effective with correctly planned and implemented processes which must focus on the right target public and the right political decision makers. In order to achieve this, various fields of knowledge as well as lobbying skills, methods and techniques are necessary, which each lobbyist should possess. Only a correctly planned strategy and diligent implementation of the lobbying processes represent the key to the desired objectives established between the lobbyist and their client. Establishing a legal framework for lobbying can ensure greater transparency of lobbying as well as the admissible and desired activities of lobbyists and lobbying organizations. Therefore, it is essential for the EU to perform the necessary activities to provide legal regulations governing the pursuing of interests on the one hand and the decision maker’s activities on the other. Lobbying is thus a necessary democratic activity which, based on adequate legal regulations and the force of arguments, can provide a broader view on democracy in the public interest.
